I have cancelled card and the man at hsbc is trying to reverse the payment. I work in the health profession and this is clear targetting of vulnerable people. He said at some point a small fee would be taken but looking at all my details "on his screen" it would be worth it.

I hope HSBC can sort this out for you, but I would definitely still contact Trading Standards and the police as they can't be allowed to get away with theft xxx

I think the same firm rang me yesterday and I said I wasn't interested and they put the phone down. They do sound good on the phone though but from waht I had seen on the forum I know I am in the best solution for me. If they say a 1p and then take £500 then its theft pure and simple.

Also try your local Trading Standards office, I am sure there is some legislation regarding a 'cooling off' period for distance selling, don't know whether it applies to finance though.

Its terrible melanie i cant stop crying- i had this a month ago with churchwood who took 500 too and then offered me an iva the day after without a refund of 500 which totally lost my trust. Its a minefield. Also everyone at churchwood says something different about ccjs on a dmp- all give different statistics.

I would love to go with you melanie. Its just the nature of my work im constantly having to make out large cheque payments to defense organisations, my car insurance is 900 etc and I fear under an IVA there would come a month that I go over limit as a preofessional fee is taken out and it goes overlimit. In my line of work I cant be so rigid. Shame you dont do DMP

Abacus are fine I did my dmp with them as an IVA was not suitable for me straight away. You really will do no better than abacus for a dmp if an iva is not suited to you at the moment. They were really good with me. Perhaps see if you can have a personal chat with David Mond just to put your mind at rest but I would reccomend them 100%.

ivas4us how did you find the creditor response- ive been suggested 280 on a 49000 debt. Do they spot early if a ccj/bailifs likely

I will identify with my team who you are and start the ball rolling to try and get back the 500 pounds from either HSBC for lack of consideration or via other methods - like money supermatket.com

think mine was pretty similar at the time figures wise. I got a couple of letters to begin with and just rang them up and explained what was happening and they were fine. Some creditors really started coming on strong when I went for the IVA, Lloyds TSB were relentless with phone calls and VW started ccj proceedings. While I was in the DMP the creditors calls and letters were manageable and did not worry me. I spoke with a gentleman called Ali at abacus and he was superb. Personally I think you need to have a chat with David Mond either by phone or email as I beleive that he will put your mind at rest. He does work tirelessly to fight the corner of all his clients and more besides, he is a true gent.

Im still worried about legal action. If i pay monthly, i have a good wage is this unlikely.

A DMP is a gentelemans type agreement and yes technically they can still take legal action but generally it si not in the creditors best interests to do this. Why is an iva not suited to you at the moment out of curiosity

Im a professional and at times of the year I have to write bulk cheques for membership fees etc- sometimes 1000 or 800 per time- I fear in constraints in an IVA I wont have the flexability to do this. A colleague may say you must go on this course next week its £600. Also in iva when my pay goes up in 3 years a huge amount will go to creditors prob whole sum owed

Sorry, yes I do remember now you saying that earlier. As a thought perhaps an IVA could be arranged where by you could keep a lump sum back for work expenses (assuming you get the £600 back for the courses) and use it as a buffer for work (only a thought an IP will need to confirm if this is possible). In an IVA you will never pay back more than what you owe so even when your wages go up your IVA will finish when you have paid back 100p in the £ plus your IP fees and any statutory interest.

Wintherace - you are in very safe hands with David, and whilst I would love to have you as a client, you really are in the best place for your circumstances right now.

David is passionate about people being ripped off, he has a big voice in the industry, and personally I think he needs to tackle both this company and Churchwood for the monies they have both taken off you.

Please don't cry. These evil people should not get you down like this, and if there is anything at all I can do to help, you know where I am. I am personally incensed by this story.
