ive drafted a letter with my proposal and all expenditure and will send it tomorrow , only problem is they have yet to receive my file so they wont be able to review my case until they do will they?

because the company closed down. only heard about this week when i got a letter from my new company, thats why im a bit disheartened by the whole process at the moment.I tried to contact my old ip on several occasions and no reponse and then i find out theyve closed by letter !!

Surely Beckys original IP should have raised the possibility of the lease termination prior to her entering an IVA ?
As you say it will ultimately be down to the landlord,but how would he or she know about the current IVA ?

Absolutely the IP should have discussed this with her and examined a copy of the lease. The landlord should have been put on notice about the IVA as a contingent creditor. I feel that this is often missed in trading voluntary arrangements.

Don't worry too much about the lease at the moment - have you checked the document to see whether there is provision for it terminating under a voluntary arrangement? If there is, then discuss the implications of this with your IP first, which may involve telling the landlord the situation. I am sure that your landlord will not want to lose a tenant who pays her rent regularly.

THERE ISNT IN THE ONE I HAVE BUT WE'RE IN THE PROCESS OF NEGOTIATING A NEW CONTRACT.
I have sent my IP a letter today proposing a reduction in payments but for the duration to extend a further 12 months to 6 years.The dividend I need is 26p in£ and after all ip fees there will be 27p in £ for creditors in my new proposal , do you think this is reasonable , as if I continue having to pay out what I am now it , i know my iva will fail

I think that will be acceptable - well it certainly would persuade me to put it in front of your creditors.

Thanks Melanie , i feel much better about the whole thing now. Fingers crossed I can forge a better relationship with my new ip , and finally get on the road to paying all this off

Quick update. Spoke to my ips assistant on Friday they've been through my file and it says my wages are £960 a month (which they've never been) ive sent a copy of last 3 years accounts to prove this but the girl I spoke to on the phone wasnt very helpful and basically said I signed to say thats what my wages were so theres nothing i can do about it now. I explained that at the time i was that desperate I would have signed anything to get myself out of the mess i was in but she didnt seem interested. I know this is my mess and I know the responsibilty to creditors is mine , but my Ip is gettin paid to do a job.I know this probably sounds like I wont be happy til they just agree with me, but I seriously cannot afford to live on whats left

I do feel that on the info that you have supplied that you are someone who wants their IVA to work but is getting very frustrated at the seemingly inflexibility and lack of empathy from your new IP.
You need to be very persistent and please do not give up.
