Hi my friend has an iva and he is being investigated by the company as they are saying he works but does not, who, why and how do the iva company find out these things?

He is very distressed that someone thinks he is being untruthful in his iva.

Are you saying your friend is in an IVA but has lost his job? If this is the case he needs to speak to his IP, and also supply documentation to show he is no longer working. If he is the sole wage earner then his IVA may be at risk. However I could be wrong here and I'm sure some one will be along soon with an answer.

Hi wizard thank you for your reply, my friend is 68 years old and only has his pension so why would anyone say he is working?

Normally, to be in an IVA you need to be in employment. How long has your friend been in an IVA? is his unemployment something recent. Is he having difficulty making his IVA payments? these questions are all pertinent and will be asked by his IP. NO matter what else happens I would say he must talk to his IP as soon as possible. come on Andy, Size5, Kalli, Melanie. Help me out here

Hi Wizard thank you for your support here. My friend was not working and is not working since the iva was took out. He went into the iva on a pension only? The company is now investigating him stating he is working, but why would they think that?

This has to be one for the experts I think Tina. As I said before it's unusual to allow an IVA if not working, although a pension may be different. I've bumped this back to the top of the list and I'm sure a real expert will pick up on it and supply an answer.

Their suspicions have been aroused for some reason. He could give his IP authority to enquire via HMRC to see if he is registered as an employee with anyone, alternatively his IP could use search agents to investigate his activities. At the end of the day if he is not working, then he has nothing to worry about - but it would be sensible for him to arrange to meet with his IP to see what has given rise to their suspicions.
