IF I WAS FAIL AN IVA AND MY IP PETITIONS FOR MY BANKRUPTCY IS IT POSSIBLE TO START A NEW IVA? IF SO - HOW WOULD YOU GO ABOUT THIS?

Hi there and welcome to the forum

If your current supervisor petitions for your bankruptcy, and an order is made, there is nothing stopping you proposing a post-bankruptcy IVA, butyou will need to persuade creditors to accept this. If your current IVA is failing, what things will you change to make a new one work - and is a variation to the original not a better idea?

If you are struggling to pay your IVA currently the first port of call would be to discuss this with your IP. There may be a solution to any problems and it would be an easier process to resolve the issue this way rather than failing your IVA and starting again.
