Hi I received 2000 for a goodwill gesture from my last employer I was dismissed for gross misconduct and on my appeal against this I was awarded the money.the iva company I am with said this was a windfall I am to pay it back in full at the end of my term,as I out of work for a while i believe this should be classed as loss of earnings, are they right to make me pay it all back to them.

If this money funded your living costs while you sought employment it is arguable that this could be treated as a redundancy payment and dealt with accordingly. This would allow a payment break but the money would not be deemed a windfall unless you found work before it ran out.
