Yes hopefully they will accept payments to date in f&f. Fingers crossed for you. They have to call a variation within either 21 or 28 days depending on your terms so chase them up if you don't receive confirmation that the meeting has been called.

Don't hold your breathe Kallis3, just called and struggled to even get them to say they had received my email. Been told it will be 5 days before the variations team even look at the email, then they will have to ring us etc etc, in the meantime we are sat here with the worry they will take the December payment of 734.00 which will mean we cannot pay Decembers mortgage. I have told numerous people this over the last week but I would get more response from a brick.

Personally I would print out your email and post it first class registered/recorded post with a covering letter addressing your concerns and stressing the urgency of the answer needed. I presume one missed IVA payment would not constitute an immediate failure/breach of your IVA so you could check this and miss the next payment whilst the position is bottomed out but make sure first!.

Can you inform the bank that you do not want to pay them in December?

I suppose it depends on whether or not it is DD or SO.

We are getting there slowly but surely. Had a call from the variation team to discuss the CIC form and it seems they want to go for payments to date and leave the payments that I have put aside since June as a back up if with this fails. The only thing I'm not sure about is they require proof that my husband is retiring! Not sure what to send them to prove this, do you think a letter from his employer would be enough, he does have his pension payment figures from the DWP but I know you can get these months in advance.

That's good news - I think a letter from his employer should be enough but just confirm it with them next week.

Thanks Kallis3, I find the support on here a great help and helps me keep clam. I am unfortunately a 'worry wort' I am now worrying that the payments to date will not be accepted but if I apply calming logic to it they would not propose this if the did not think it had a chance so trying to keep myself calm. It's going to be a challenge for another month or two but if I've managed 5 years I can manage these.

Hi Sheila - glad to hear things are moving forward for you. A letter form your husband's employer should suffice.

Sorry for the delay in updating. We had a phone appointment with the variations team last Monday and it was decided that we would put the following before the creditors with the hope of acceptance. The four months payments for June, July, August and September that I kept to one side would be used to pay December, January, February and March and then the IVA be deemed completed with payments already received. No date yet for creditors meeting but will keep you informed, wish us luck.
