Sorry folks more advice needed as currently worrying myself silly. The terms of the variation were, 4 more payments from money put aside while waiting for equity answer and payments made to date but we have had a problem at home this week, the boiler/central heating system broke down on Tuesday, the cost is over £800 which has had to come out of the money saved. What will be the chances of getting the variation changed even though all the paper work has been sent to creditors. I feel as though I am failing badly at the moment as I cannot hold up my end of the variation proposal.

I not sure you can simply change the variation. I think your IP may have to put another variation to creditors to approve, unless they can use their discretion within the terms.

Personally as long as you had paid the full sums agreed by the end due date this would be acceptable to me.

Well today was the day and just received call regarding variation, it's been accepted #128516;. Only one small issue, they are willing to write off half the cost of the money used to pay for repairs to the boiler/central heating but I still need to find an extra £500. Looks like eBay and car booting time to sell what to us is junk plus around 200 books accumulated over the years. The last step is always the highest #128540;

Good news Sheila except how did this extra £500 come about?

Ask to see this modification - you should agree it before it is formally treated as having been approved.

It sounds like the IPs fee for calling the variation meeting to me...

Hi Lisa, it's because I had to use £960 pounds of the 4 months payments I had saved to pay for the repairs on central heating. The payment should have been for £2948, I paid £734 at beginning of January and £1350 today which means £864 shortfall. If I can find another £500 they will write off the rest. No idea where I'm going to get it other than selling something, not sure what apart from lots of old books etc.

But creditors must have insisted on this modification as part of the deal and your IP has to put it to you, and get you to formally agree the modification, before it is accepted unless that's how the original variation was worded in which case they should have told you that before the meeting. It sounds a little odd to me, although I appreciate I don't know all the detail.

Well we are still crawling towards the finish line, final report and cc not received yet but we are nearly there :-) Two weeks ago we were asked if we still had copies of our letters for ppi claims as they were having problems getting the figures, so I emailed them copies of everything. Imagine my surprise when one week later my husband received a cheque from Aperture for £3200 statutory interest, woohoo. The following is said tongue in cheek, as we have not received our cc yet could they technically class this as a windfall :-)) and expect us to pay it back to them lol

Hi, nice amount to receive. Hoping that completion certificate is received very soon - have they given you a timescale?
IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.

Expecting it by end of this month. The cheque was a big surprise as didn't really believe we would get anything. My head is still in IVA mode so it's telling me to stash it away just in case but it would pay for two tickets to New Zealand to see my sister, decisions decisions lol
