Ive come home today to find a letter from EIF/DFD telling me to complete a form to the Financial Ombusman to launch a complaint against one of my 2 outstanding PPI cases.

My question is has anyone else received one of these?

Feeling very down today as it will be 7 years now since i started my IVA and i still dont know when i am going to get my Completion certificate

I guess this is because your creditors are not accepting that they should offer you compensation, and that our claims management company now want you to lodge a complaint with the Ombusdsman. Notwithstanding this process, is there any reason why your IP cannot now close your case following the recent regulatory guidance in this regard.

I had a similar letter from EIF and I'm with PayPlan. It mentioned that although the creditor had accepted that my PPI was mis-sold and would refund it to my IVA, they want to offset it against my debt with them only. I signed the Financial Ombudsman complaint form and sent it back to them. It shouldn't make any difference to when my IVA completes, (next month), as PayPlan had a mass variation with all creditors agreeing to let the IVA complete even with outstanding PPI issues. I don’t know about DFD, though.

i think its cause the PPI in case is worth £4k roughly and so the IP says that he cannot close the case without it. :-( I just want to sit and cry.. It seems like I am never going to get my completion certificate even though i have complied with everything and more that has been asked of me.

I completed payments july 2012 and EIF have been doing this crappy PPI for over 18 months now and have got no where..

Melanie am I remembering right that you have a contact in DFD who is above the IP's?

Mine has decided to ignore my polite emails and questions again and I need to get some concrete answers.

I've just checked that link, and for some reasons it is taking me IPs with the surname beginning with S rather than T - so just click on new search and type Antoinette's surname in the appropriate box and this should bring her up.

Hi Loopylass I really feel for you, EIF wanted me to do this but when my MP got involved they were instructed to close the case down by my IP, I think the fact that I was able to pay back 100p back as well as all the fees did play a massive part in it though.

Do keep onto them, it isn't your fault that the banks have decided to off-set debts which they probably have sold onto another recovery firm so getting more than they are actually due.


Hopefully now that they have proper leadership within this company this will get resolved sooner than later, good luck and best wishes, fingers crossed.

Have you got all yours completed now? If i remember rightly you were waiting for the hard copy of your completion certificate?

Hi Loopylass, yes I have got my hard copy, so for me my dealings with both EIF and DFD have now thankfully finished as I have been removed from the insolvency register and the charge placed on my house has been removed.

I wish you luck with this, did the ministry of justice not have anything to say as I know you were going down that route?

It really isn't fair that by trying to realise a better return for your IVA and you have complied with all that has been asked of you, you are now the one that is being prevented from what is rightfully yours. EIF want shooting, they sit on their backsides and wait for things to happen instead of biting the bullet and doing what they are being paid a very high commission for! They should've sorted this off-set out ages ago and challenged it when they first knew about it, seems like history repeats itself time and time again with this company.

glad you have finally got the hard copy and your journey is over

Ministry of Justice couldn't do anything about EIF as they are a 3rd party and it would need to be DFD that put the complaint in grrrr

Im writing to Melanie's friend tonight to see if she can do anything as the IP has ignored 2 emails in the pass 2 weeks so i am going to see what she can do for me.

I cant believe how bad a company can be and will never ever be recommending either again :-(

That isn't fair Loopylass, I've just found out that Max recovery have been overpaid on one of my debts so there is a small surplus being held by them, I phoned them today to be told there was 8% interest to be paid, to which I informed the person I was chatting to that NO I had a variation meeting on 18/2/13 and one of the variations was to waive statutory interest, needless to say I now have to email them with the details so watch this space. I'm beginning to think that someone somewhere hasn't done what they are supposed to have done!

Hopefully Antoinette will be able to pick this up for you and get a speedy conclusion.
