I would definitely speak to your IP. If you do need to take a payment break, you can always put a bit extra onto your monthly payments if you can afford it so that the IVA doesn't continue on.

I know Lesley has done that.

As I see it you are entitled to half regardless of who the cheque was made out to if you both paid the premiums.

It may come down to how the events were sequenced. Unless an iva can quash a consent order giving away future assets. Definitely one for the legal eagles x

No, an IVA wouldn't supercede a consent order signed by the courts. Slightly different under bankruptcy.

At the very least you are entitled to half as it is in joint names so I would be nagging his IP to get it sorted asap!!!
