IVA aproved more stressed than before!!!

Hi All - long post be warned

I got my IVA approved on 24th September - great news eh?

Its not started off well and I'm stressed/worried!

i had a loan with HSBC which is part of the IVA - on the 1st Ocotber the took the loan payment from new bank account. So i contacted DFD he said they would send a letter to get it refunded. I got a letter from HSBC saying the money was being returned. I've been checking my bank account to see if it was in and it didn't appear. I decided to check my old HSBC current account they had returned the money to that account. To make matters worse they have also taken my loan payment for a second time on 15th Ocotber i must not of cancelled the direct debit in time.

So DFD are aware of all of this. I've been into HSBC who were refusing to return the money that was a credit in my old current account. The second payment they have taken seems to have disappeared somewhere else. I spoke to HSBC yesterday and the credit that was in my current account is now no where to be seen. DFD have copies of the charges and credit, i got told yesterday by someone that at 8am this morning when she got in she would would fax HSBC to get them to return the money. I spoke to DFD tonight nothing has been done.

I'm so worried HSBC have £466 of my money somehwere thy pass me from pillar to post claimimg no one knows about it. I'm overdrawn in my new bank account becasue of this and I'm going to be charged £35 for this. I haven't even made my first IVA payment as HSBC took the money before i had chance.

Sorry for the long ramble - I don't know what else to do. DFD are so blase and don't seem to have any advice. I always end up speaking to a different person. Should i have a nominee or something or i can always contact and speak to the same person. I don't know any of these details.

Anyone any advice? been through this? will i see my money again?

Don't worry. This will all be covered by the IVA. You will not lose out at all.

I am confused though as to why a DD to HSBC would be set up on your new account. I presume that you have opened an account with a different bank who is not a creditor? If so, and you did not transfer the DD across, HSBC cannot touch this account.

Badger DFD - they are the ones who should be sorting this out for you.

Howevever, you will be covered by your IVA.

I opened a new account with Natwest before all the IVA went through. And all my direct debits got transferred over. Partly my fault i guess but when the IVA was approved DFD said i didn't need to do anything so i forgot to cancel the DD - hence why they took it on the 1st Oct, i obviously didn't cancel it in enough time and they've taken it again.

HSBC are awful to deal with - no UK call centres, and passing my about, certain departments they are saying I need to speak and they are only open when I'm at work. Its a nightmare and really stressing me out.

DFD seem convienced all they need to do is send a letter and hey presto I'll get my money - when i speak to HSBC they make it sound like that money is lost for ever.

I really don't know what to do

I know what HSBC are like, they are one of my creditors.

Keep on at DFD, they should be sorting this out for you. In the meantime, cancel that DD.

Thanks. DD is cancelled I've checked several times.

I was so looking forward to some things becoming easier! hopfully it will be soon.

£466 is a lot of money to have missing!!!

I am more then happy to deal with this on your behalf and ensure this gets resolved as soon as possible. The last thing you need is this happening just as your IVA begins. That's great news lollyollie that Declan is going to look at this, I'm sure he'll soon have it sorted.
IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.
