IVA co writing to my employers to inform them

I am currently in the process of applying for an IVA. The company I am doing it through said that they must write to my employers to inform them. Do you know why this is as when I have researched this on the internet there is no mention of this. Also do you know if my job may be at risk as I work for HMRC?

Hi Nicsy and welcome to the forum. I've never heard of an IP writing to an employer to inform them before - which company are you with?

Regarding your job, you would need to check the terms of your contract, or contact your HR department (anonymously if necessary) to check.

Thanks for replying so quickly. I am with a company called McCambridge - Duffy. I originally rang Debt Free Direct and they transferred me to them as my husband is self employed and they only deal with employed people apparently.
I rang my HR dept but they wouldnt let me ask a question without providing my full name and staff number which obvioulsy i didnt want to do.

I have not come across an IVA provider writing to and informing employers.
Take advice from another IVA provider,or two
An IVA is a private matter,there is no need for your employer to find out,unless you have debts with your actual employer

OOOOOhhhhh how awfully worrying for you. Hopefully an expert will be along shortly to advise you better but since posting on here I have never read anything like this.

I'm sure that one of the experts knows of this company?

Hello nicsy,

Do they want to write to HMRC because they are your employer or could it be due to outstanding tax liabilities connected to self-employment?

Absolutely correct Andrew. In self-employed cases we always have to write to HMRC regardless of whether there is a debt or not. Don't worry nicsy, this is unlikely to hit your HR department and affect your job at all.

Ok I understand now. The lady I spoke to did mention that we needed to but this tax years self employed tax owing into the IVA. She did not mention that was why they needed to write to employer though!! She said without even discussing my case I should do a voluntary repayment thing (you know what I mean!!) as they have a dept in their office that dealt with them. I told her I would prefer to go down the IVA route first as that was what Debt Free Direct had recommended. I also explained that I would not be able to go bankrupt as I would lose my job as I worked for HMRC. She said well we write to them to advise them of your situation so maybe its not for you!!
I am quite annoyed as I have not slept for 6 nights now with worry (as if the situation itself is not worrying enough!!).
So am I right in thinking that as we are to have seperate IVAs (myself and my husband), as she did explain that if one of our IVAs was not agreed they both would not be, that only the IVA info for my husband will be send as it is only his debt??

That is correct nicsy - and do make sure that they arrange a face to face meeting with your husband as that is mandatory in all self-employed cases and actually really important. Stay on the forum and let us know how you get on.

Nicsy ... my IVA was with McCambridge Duffy and they did a very good job of it. As I am self-employed they had to liase with HMRC something to do with my first few payments being higher to include tax payments ... or something.

Good luck ... and keep in touch with the Forum as you are amongst Friends here.

Absolutely correct. And even if they did need to send yours (which they don't) this would be very unlikely to get anywhere near a HR department.

Its just to let you know that i spoke to McCambridge Duffy today and explained that they will only need to send in my husbands details to HMRC but they are still insisting that they need to send mine. Apparently HMRC have it in a legal clause of an IVA that if you work for them and take out one they must be informed.
