IVA COMPANY DRAGGING THERE HEELS.

Hello all,

What a wonderful website this is. I wish I would have discovered this before I went into my IVA as the advice given on here is excellent. Is there any way we could encourage IVA companies to recommend this website to potential IVA customer's?

I was just wondering if anybody could give me some advice please?

I went into a full and final IVA on 29 March 2007. I sent my IVA company my lump sum payment in July 2007. To this date I have still not received my discharge certificate to say my IVA has been completed. I have been in contact with the comapny on several occasions to ask what is happening to be told on each occasion that there are some claims outstanding and these will be chased up.

I just want this situation to be sorted out and so that I can move on with my life.

Is there anything I can do or anybody I can complain to about this? This company is getting a lot of money in fees from myself but the service is absolutely atrocious.

Hi W75 and welcome to the forum

I don't really feel that you have sufficient grounds to make a complaint, as your IP cannot make a final distribution to your creditors until all claims have been agreed. This does, however, assume that they have been chasing this matter along for you, so I would ask them to provide you with details of the creditors so that you are aware of what is happening.

If it's any consolation, your IP is probably as fed up as you are, becuase if he is like me he will not be drawing his fee until his work is concluded.

Hi W75,
My F&F IVA was approved in August last year and It completed last month. It was only when I started ringing my IVA company every week that things started to move. I think that you will now have to truly make a pain of yourself to get things moving. Ring them every day if you have to. That should soon get things moving.

Cant Ips exclude the creditor from the dividend if they mess about for too long and ignore repeated requests for a final figure?

Yes - but they have to make sure the creditor has been given ample opportunity to submit their claim.
