At the end of the day I am getting what I signed up for --- and a lot less money is dissappearing in interest in the meantime !! Yes, there are worrying stories about it taking a year to get that certificate ... if when the time comes, mine takes that long, so be it. T'will still be a lot faster (and cheaper) than paying the debts for ever and a day!
As for potentially losing windfalls, should I get any --- they would have been absorbed itno debt repayments anyway, so I am no worse off !!!
As Martin (not Lewis) would have said ..."ebb,ebb,ebb .... flow, flow, flow"
My opinions are merely that .. opinions based on experience. Always seek professional advice.
IVA Completed 23rd July 2013 .... C.C. 10th January 2014
I understand what your all saying but I cannot afford £500 per month no wya. I have asked for a variation and they may as well have said b***** off! They said that they would increase it again in another 6 months! How this can be allowed I do not know. As for bankruptcy, well I think it now seems the best option. I have spoken to an IP from another firm and he says that the receivers go by something called the HES which I found here: http://www.insolvencydirect.bis.gov.uk/ ... ex%20D.htm
He said that there are other permitted outgoings and after doing an income and expenditure with me, I do have approx 36.78 left at the end of the month. So I wont be getting an IPA for £500 per month will I....
Im not that bothered about having the ppi money I'm more concerned that they obtianed it without my consent. The OFT were open about the investigation because they said that hundreds and hundreds of people in IVAs had complained about thsi already and its a serious matter and they need more information. Sounds to me like there may be trouble ahead with this and too rightly. I just feel very let down and mis advised. I cam on here to see if anyone else had this problem and it seems they have.
Thanks for your replies. I am fuming right now. I just complained to Harrington Brrokes and they said that they can do this without my consent because they said and I quote "We have the power to do this whether you like it or not"
My IVA company has been on the telephone this afternoon apologising and asking me not to complain, after seeing my post on here. Bit late for that.
Has anyone else had this problem as I see quite a few on this website have with various companies, be interesting to see if they have complained also?
Hi terryibs55. I've not had that problem thus far. I've read your posts and have been very perturbed by what's been reported. What did they actually apologise for, and how satisfied are you with it? Did they tell you what they plan to do now? A few question, but info might be helpful to others.
IVA journey started: 30th March 2009. Settled: 17th July 2012. Completion Certificate received: 13th March 2013. Breathe. x
Well I got the impression they were panicking because I told them I had complained about the ppi thing and that they had not had my consent. They said that they can rectify this and when I asked who the third party was that they said was acting for them obtianing the ppi, they got quite shirty and said that it was none of my business. I then asked them why they did not advise me on bankruptcy when they knew that I could no longer clearly afford the IVA. They said that its tough luck and Im legally bound by the IVA and I have to pay it or they will come to my home to collect the money! They said that I cannot stop paying and that there is no way on earth I will be able to make myself bankrupt without their help. I then told them that I am now getting help from another company and they went really snotty with me. I told them that I had made complaints to the OFT and ICO and they didnt like that and said that its not just them thats doing it, all IVA companies do and it would not just be them that gets it in the neck.
I am really at wits end with them and I now feel that going bankrupt is somethign that I should have doen months ago. I though that reputable companies were supposd to give you the best solution to suit your situation, not try and pull the wool over your eyes...
Having spoken to the the FSO and the ICO I think it's only a matter of time before the proverbial hits the fan re: debt management companies. Do what's right for you - just be selfish.
