IVA company refusing to issue termination certificate unless I take out PPI claim. Is this legal ?

hi i have a court date for my bankruptcy on the 20 septemper i am in an iva i have not been able to pay my iva for 8 months and have asked for a termination certificate but my iva company has refused to let me have one unless i take out a ppi claim with all the banks and cards on my iva is this legal i rang and said i need this certificate for about a week and they are refusing to give me one until i take out ppi with them my court is newton abbot devon

I don't see that they can refuse to issue this as your IVA has obviously failed.

Which company are you with?

Welcome. I would have a word with the Court and see if you can speak to whichever OR will be appointed. The PPI, if there is any, will belong to the OR and not your ex IP and, I imagine, he would not be best pleased if this is paid out now.

I agree with Foggy that you need to speak to someone at the court. It may be that you won't need anything as not all courts do.

Do you have any paperwork at all from Cleardebt stating that you've stopped making your payments?

no i have no letters stating we have failed to make payments because they knew we were applying for bankrupytcy 6 months ago and have not stopped pestering us to try to claim ppi from our creditors on our iva

Hopefully one of the experts will pick up on this and advise but in the meantime, speak to the court tomorrow.

hi my iva company is clear debt has any one else been refused a termination certifiate until they agree to take out ppi claims with them i have spoken to the office manager and he agreed they will not issue a termination certificate please tell me it is not just me

i have read other posts on here and i have noticed clear debt have replied to there posts so i hope they will respond to mine fingers crossed

I believe Size5 who is from Cleardebt is on holiday at the moment - hopefully he will be back soon to reply to you.

If size5 does reply that would be great then he can explain clearly and you all can help me understand and help me finally get my termination certificate
