In the circumstances you have described, I would have thought that a Termination Certificate is exactly what your IP should be issuing seeing as you have told them you are applying for bankruptcy. If they refuse to provide you with one prior to the Court hearing, ask them on what grounds and that you will be highlighting this to the District Judge.
I have just spoken to clear debt and they will not give me. A termination certificate because they have staff investigating my ppi as demanded by the courts as part of my iva is this correct
Hi, I'm also with cleardebt, although in an ongoing IVA. Have you tried emailing David Mond cleardebts CEO? I would give it a try as I have found communicating with him to be te best option by far. I once asked my caseworker if she could give me his email address but unfortunately never got a response so I just typed his name into a search engine and got it that way. Other wise if you can't find it try david.mond@ then add the company name after to form his email address. I am not allowed to put it in completely on this forum but I think you get the general idea f how to finish it!!
If you have determined that you wish to terminate the IVA, then they should issue you with the Termination Certificate. This does not stop them pursuing a PPI claim which may have been captured under the terms of the IVA, as this can still be done once a case has terminated or been closed. If you are expecting quite a significant PPI reclaim, it might be possible to save the IVA, so do be sure that bankruptcy is the right way forward for you based on all circumstances.
I have a question which I am certain many forum users would like an answer to.....IP's are claiming back PPI how do they go on if you were NOT MIS-SOLD PPI all the adds I see state "if you were mis-sold ppi" etc.
Claims should only be made for genuine situations where PPI was misold to a customer i.e the customer did not know what they were signing up to, the PPI was included without their knowledge or some variation of that kind. Unfortunately there have been cases where come clients are being pressured by companies to make claims that do not appear to have been misold which is both unfair and unethical.
Only the client can confirm whether they were misold the PPI in the first place or not.
