Since getting my IVA almost 2 years ago I have received many letters suggesting I can get out of my IVA.

I have seen these as unscrupulous attempts to feed on my vulnerable situation by companies hoping to make momey out of it.

Today I received a letter which seemed different. It was from the IVA Council informing me that I may have been missold IVA as a course of action and that test cases are being taken to court.

Does anyone know anything about this and is it bona fide?

Hi May07, this seems to be a common letter sent out, judging by previous postings.. don't think they are highly thought of. I'm sure somebody who has received one will advise you soon

This is not an official government body - although their letters are scripted to look like they are - and they are simply offering their services to people in IVAs whose details they get from the Insolvency Register.

Their stated aim is to be crusaders for people who they believe may have been "mis-sold" their IVA due to inappropriate advertising or advice provided by IPs. This has a double edged sword, as they are also offering their services as bankruptcy experts and are suggesting that they be funded by instructing you to stop making your IVA payments - which will cause your IVA to fall into default.

It is really up to you to determine whether they are bona fide - but it might help if you read the statement on the Home Page of the Insolvency Service's website, which is a bona fide government website.
