if your iva fails is it law that your ip will have to proceed with BR?

Don't think so, you can go into DMP instead if you can afford the repayments. It will take longer to pay off and you may not have all the interest frozen.

In an IVA no, in a Scottish Trust Deed usually yes (Sequestration)
