Hi

Could anyone tell me how long it takes to receive the failure/termination notice after missing 3 IVA payments??

Hi,

Sorry to hear that your IVA has failed. Your letter should come through shortly, if it doesn't, then I would phone your IP.

Can I ask if there was a particular reason you had to miss the payments? What are your intentions now?

Thank you both for your speedy replies.
The third was missed (unfortunately) only yesterday. Just trying to think ahead and plan for when I have to go bankrupt, as I understand I need the notice of failure from my IP before I can do this? Just wondered if I had to wait weeks or months or if they tend to send it pretty much straight away?

Im sorry I had to fail it too. Its due to me loosing more than half my income which made the IVA payments impossible. I have no choice now but to go bankrupt.

Hi - you do not necessarily need the notice to go BR. Phone your local court and ask them what papers they require.

Also email your IP direct, requesting the notice in preparation for BR - they can email you a response which may satisfy the court. I know hubby didn't recive his notice until weeks after he was declared BR.

I'm sorry your IVA has failed, but if you are going to go BR, I would act sooner rather than later.

IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.

Thank you lesley and ladyh for your kind words. Im sure it will all work out in the end. Feel the same as I did before embarking on the IVA, but hey it cant get much worse than bankruptcy can it![^]

It's really sad when an IVA fails.

Have you spoken to your IP about it at all to see if it can be salvaged? Or are you just not able to sustain the payments anymore?

You will need to save up the court fees of £510 for BR.

You can fill the forms in online and we are always here to help you with any questions you may have about them.

Hi Kallis, Im just not able to carry on with the payments at all, just dont earn enough now. I am very disappointed I havnt been able to sustain it. This is the last thing I wanted to happen and feel that not only have I let myself down but my IP who worked really hard and never judged me and my creditors for agreeing to the IVA in the first place. Still, Im not one to dwell. There is nothing I can do to change the situation- except a lotto win of course and theyd all get the whole lot back..!! I just have to pick myself up and move forward. Thank you to all for your replies and good wishes, I have found both this forum and the bankruptcy forum invaluable and extremely informative.

I'm sorry to hear that your IVA has failed. I know it's easier said than done, but try not to worry too much about going BR as it isn't the end of the world.
