IVA if I've recently moved to France

Hello I wish to take out an IVA against a loan and credit card that I am having big touble paying back. They are to UK banks but I've recently moved to France; can I still have an IVA if I'm living outside the UK I really need to do something about these debts. I'm unable to phone as your freephone 0800 number only works from within the UK can you send me another tel number that I can call from France. Thanks.

Hi Jenny and welcome to the forum

You are able to have an IVA if you have lived in the UK for the majority of the last six months, or have retained a permanent address within the UK, however I note that you only have two debts and, if so, an IVA will probably not be a viable option.

Do you have any other debts? If not, then I suggest you contact the banks and explain your circumstances. They may agree to take reduced monthly payments from you to avoid the need for a debt management plan, where you will pay for the services of a specialist company (unecessary in my opinion if you only have two debts). If this does not appeal to you, and you have no material assets, then you might wish to consider bankruptcy proceedings in the UK - again only possible if you have lived in the UK for the majority of the last six months.

French bankrupty law is somewhat more restrictive than English law, and involves a heavier involvement of the Court in managing the procedure.
