Hi all,

Has anyone else been recieving letters typed up in red from an IVA company based in Poole,Dorset ?

I am currently in my IVA, and very happy with it, yet they have insisted in calling and mailing me information regarding 100% legal write off - of which I know is just a ploy to get those who really need help.

I have told them I am in an IVA, and that I would like to know where they got my details, but no answer so I presume they are getting these from the insolvency register perhaps ?
Started IVA 27th Feb 2012 - Due to complete 27th Jan 2018 !!

Full & Final submitted and accepted 30th March 2015, paid 10th April 2015 - 3 yrs 1 month into IVA :)

Completion Certificate received- 30th April 2015!!

demand they remove your name from their data source, I do and it usually works, only ever had a couple.
IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.

Mrs R - not had anything myself but ignore these companies - they are just BR assist companies and will be getting your details from the register.

Throw the letters away and tell them to get lost. They have no idea how your IVA is going.

I'd be less than polite the next time they contacted me!!

They do tend to target those that are fairly new to IVA and so might be able to be 'persuaded' to change their minds.

I'm almost five years in and have not had any of these in a long time.

This is bizarre. It is likely they have obtained your details from the register but short of making you fail the IVA, via a petition for your own bankruptcy or asking your creditors to agree and amendement to allow you to exit early, there is very little they will get out of writing to you if you are already contractually bound. This is what they do Sam - they trawl the register and then try and get you to go bankrupt and they will charge you for the privilege of doint so.

Unfortunately if people believe what they say then they can let the IVA fail and go with them.

Not everyone has found the forum and they will believe these companies.

That is truly shocking. I know many firms receive payment to assist with the bankruptcy petition and it is bad bad bad. I know of cases where we have been appointed as Trustee and the bankrupt has paid £2,500 to a company like this to 'assist' with the petition. Technically this is a transaction at undervalue and can be challenged by a trustee. I am writing an article on it at the moment as it happens! Would you like me to send you a copy when the quarterly magazine is published ?

IVA.co.uk is an amazing place , it is a bit like AA which is a wonderful safe environment where no one is judged.

This is what these companies are like unfortunately and we do try and help posters out where we can.

Some BR companies charge reasonable fees to help and some posters do need help.

It's the ones that charge a fortune that are annoying.

Just to let you know that I'm in an IVA myself and have been on this forum for a fair number of years. I'm willing to contact you off forum - we will need to add each other as Frugal Friends to do that.

The ones that charge a fortune are in breach of the Insolvency Act!

I am considering a class action against them.
