I got one of these this morning too, we are 8 months into our IVA and thankfully i now have quite good knowledge of how IVA's work, only due to what i have learned on this forum! But my hubby hasn't got a clue and he thought what they were supposedly offering sounded great, so i can see how people could get roped in!
I'm guessing they would have told us to allow our IVA to fail so they could then set up another, or encourage us to go bankrupt but no chance of that as we have a property with equity. Talk about 'preying on the poor!'
Sam - a copy of your article would be very helpful - thank you! x
ps: like AA? After reading some posts on here, I feel in need of therapy! I do get worked up and frustrated sometimes - wishing more could be done to help 'forum family' members, that's why it's great to get updates. Best forum ever!!! x
IVA journey started: 30th March 2009. Settled: 17th July 2012. Completion Certificate received: 13th March 2013. Breathe. x
I say this because i believe that they would not have wanted you to let the IVA fail and set up another one - they'd have been wanting you to go BR and they'd have charged you for the privilege. Your house would have been toast in BR if you had equity.
Unfortunately, there are regular "mail-bombs" by companies which do trawl the IVA register.
Until there is a change to legislation, this register remains open and the data can be purchased by third-parties. Apparently suspected abuse can be reported to the Insolvency Service.
Many of these firms are based around Poole which seems to be too much of a coincidence! They have been putting out the same messages for a few years.
The truth is that even though your IVA is registered, the contents are relatively confidential. Only you, your creditors and your IP (and previously the Court) received a copy of the proposal and related documents.
Without specifics such as these, no-one else - including people like myself on the forum - can give you advice on whether entering an IVA was the right thing to do, based on your pre-IVA circumstances.
So, for these firms to state with bullish confidence that you were "mis-sold" an IVA, or words to that effect, is either clairvoyance on an unprecedented scale, or simply a guess.
Disregard the letter and if you have any concerns, discuss them with your IP. Many worries caused by unnecessary letters such as these can be resolved by remembering the reasons you are in an IVA and what your motivation was that led you to seek help in the first place.
Very few problems cannot be resolved with an open and frank discussion.
Always discuss your problem honestly with your Nominee/Supervisor.

The ones that charge a fortune are in breach of the Insolvency Act!
I am considering a class action against them.

PS if you want to add me as a frugal friend i will accept but I'm not sure how to add you!
Good luck with this, these letters were an annoyance during my IVA to say the least. Seemed like I was getting one every 6 months during the IVA and did not stop after completion with some offering to help me claim PPI and clear up my credit files.
We're willing to wipe the slate clean, give you a fresh start. All that we're asking in return is your cooperation.

The letters don't annoy me, I just them to light the fire with!
More to the point there are others in the household who have the same surname and were unaware of the IVA. They would write to Mr Surname, and letters could have been opened by anyone as they were incompletely addressed.

Correct me if I am wrong, but I think you are client of my firm? If so, please send me the letters and I will respond on your behalf. I am very fed up of this constant solicitation of unwanted services to my clients.
You can contact me via the experts page on the forum, or send to Sue and ask her to forward it on to me. I am not allowed to put my own e-mail address into posts unfortunately.
