hi everyone, we have been in our iva for 18 months,making payments of 380 pcm on total debts of around 16000,leaving a dividend available to creditors of about 72%,we are behind on payments a total of 260, our ip has given us 6 months to clear arrears, or he says our iva may fail, comments please

£260 does not sound like alot, infact less than one payment !!!

Most VA's have a provision to allow three months arrears, so i am suprised your IP is telling you they will fail the IVA.

Your IP will have a duty to report to creditors that your in arrears by £260 but at the same time advise them how you intend to catch up with the arrears, perhaps increase contributions slightly or even extend the VA by one month to catch up, and normally creditors would accept this type of arrangment.

Is there a reason why you have fallen behind with your payments, has there been a change in your I&E ?

yes they dont seem to understand my pay structure as a hgv driver,my wages are up and down like a yoyo depending on the hours i do, varies between 55 and 65 per week, and when on holiday on get paid for 48 hours. leaving me 15o pounds down on a average week. And the way cost of living has been rising lately its makin it more difficult to manage.
IP is blair endersby by the way, who i feel dont really want to know.

As you are less than one month in arrears it seems to me to be very harsh that they would fail the IVA for that reason, without giving you time to catch up.

You say they have asked you to catch up in the next 6 months.. Do you not feel this is unrealistic, you may want to suggest that they allow you twelve months to catch up on payments.

Have you spoken to the IP directly or one of there staff ?

The problem with big companies like BE is the line of communication, the IP is best person to speak with, and you may be better contacting them directly, you should be able to find there email address using the link below if you cannot contact by phone

Thanks,when i last spoke to one of their underlings (as i call them)he said i wasnt entitled entitled to speak to my IP.I will take your advice and e-mail him direct. thanks

Absolutely appalling to be told that you are not entitled to speak to your IP. Who on earth do these people think they are?

was told when i took out iva that if expenses went up payments would be reduced by a corresponding amount. last year my wages rose by approx. £90 pcm but our rent went up by £110 alone but they still refused to let me reduce the payments by the 15% allowed without a further creditors meeting. Finding it really hard working the 60-65 hours week in week out i need to just to pay the bills.

my payments are supposed to be £88 per week,volunterily increased them to £90 per week to clear arrears,,after call by BE agreed to increase payments to £100 per week to clear arrears,however last week was a little short but still paid the £90, received a call on thursday asking why they haad only received £90. THEY ARE A REAL PAIN IN THE A**e. especially when i am working a minimum 60 hour week and feeling absolutely kn*****ed
