I'm with you on this, but what else can we do?

I've signed the petition http://petitions.pm.gov.uk/InsolvReg/ and I've wrote to the information commissioner about it contravening the data protection act in the areas of security of excessive personal data with no safeguards to protecting the individuals rights to protect their data.

We should all club together and form a class action case against the insolvency service under data protection legislation.

Are you saying we're all there but becuse you have an unusual name you're happens to be the 2nd page? I've jus searched me and hubby on google...nothing and I'd got to page 24.It's awful.Truely an invasion of your human rights.I think this/ data protection are the acts that have been breached. But, google is massive. There must be thousands of violations on there.Plus, if you did happen to take to court, would you really want the world (litrally) to know who you are and why you've won a court case aginst an enormous search engine.I think they have us by the 'short and curlies'.Cat[:(]

Hello All

I just got off the phone with the IVA Register people who claimed that the information is in the public domain however I would need to speak with google about getting the information removed from google. I signed the petition and rang the ICO where was told that I should write in the issues to the ICO. So I have done the letter which is going to the post in the next few miutes. I also emailed google security on security@google.com so let us see what they have to say! Funny - I did the search this morning and it was not there!! Luckily I have printed the results of the search.

andy has previously taken legal advice on this and there does appear to be a case for suing the Government.

Therefore Andy is planning on taking a class action suit against the Governement for abuse of data later this year.

If you would like to help or be involved in the class action then contact Andy directly:
http://www.iva.co.uk/contactus.asp

Please state your name, email, tel and what your grievance is with the Insolvency Register. Specifically we need examples of where peoples rights to privacy have been abused because of the public display of their information. E.g. spam or otherwise.

Also please state if you are able to help either in terms of time, legal assistance or anything else.

That's really good news and good luck.

I don't know if I would be able to help in any way as I'm no longer on the register and I didn't get too many spam letters. I will obviously be supporting this all the way!

Here is the latest reply from my online complain to the Register Office:

Dear Sir/Madam

Thank you for your enquiry to the Insolvency Register.

I am responding to your e-mail below expressing concern about the
availability of access to your records on the Internet.
I understand your shock and it might be helpful if I explain how this came
to be.
I should explain that, under the Insolvency Rules 6A.6, the Secretary of
State has a statutory duty, to maintain and enter information onto the
Electronic Individual Insolvency Register (eIIR) where a bankruptcy order
has been made.
Rule 6A.6(1), specifies the information that should be recorded on the
register as:
The name, gender, occupation (if any) and date of birth of the bankrupt;
The bankrupt's last known address;
A statement that an order has been made against the bankrupt and,
The duration of that order.
The order can only be removed if there is an order has ceased to be in
effect or has expired.
The register is a public record required by legislation and neither the
Secretary of State, nor the Insolvency Service can restrict access to any
data contained therein.
Whilst it in no way takes away your distress at finding out about this in
this manner, I hope the above explanation has thrown some light on why this
has happened.

Regards
XXXX

I am happy to assist where I can and will gather together any info to help Andy fight his case as this will benefit all of us. I will make direct contact shortly. Thanks for all the support on this site though - it has been wonderfully empathetic.
