Can anyone explain why iva's are advertised as private with no-one finding out when anyone can go online to the insolvency register and find out details of your iva plus your name, date of birth and address. hardly discreet.

I think the better way of describing IVAs would be to say they are less public than bankruptcy. Bankruptcy is actively published in the local paper whereas IVAs are not. You are right in saying that details of someone being in an IVA are available to anyone through the Insolvency Register although this is little known about and people would have to search you under your name and address.

i wouldn't say so much there is little different,yes you are not named in the paper for iva, unless you are looking specifically for someone who is due to be named in the paper you would't notice the BR section. with an iva you pay into for 5 yrs an amount deemed feasilbe by your ip and living expenses, in BR you get a realistic amount to live on to enable you to remain solvent and live comfortable including having a holiday, in iva you are restricted to a very tight budget in BR you are discharged in 12 months and may pay an ipa for 3 yrs depending on your realistic living expenses, yes you may lose your home if you have equity, yes you may lose your car, but realistically if your iva fails coz your budget is too tight this is what will happen anyway and any fees you have paid will go to ip first before your creditors, always think long and hard and choose the best path for you.

If you wasnt in an IVA then you wouldnt know where to look for this info, I'm in an IVA and i dont even know where to look, chances are no one will find out.

It's true it's a very little know about register but it is important to be aware that detials of your IVA are not totally private.

Afternoon All,

Thomas Charles is right; we cannot say that an IVA is completely private because yes, there is an insolvency register open to the public. Although in saying this a high percentage of the public do not even know this register exists.

So with that knowledge when comparing Bankruptcy to an IVA, an IVA will still remain the more discreet of the two options.

why will it, the same restrictions still apply, ok you won't be named in the local rag for an iva as with ~BR and thats about all everything else will still be listed on insolvency register for all and sundry to see if they so wish

From my perspective, I think it is entirely wrong that this register is available on the internet, when there is no legal requirement to publicise this information. But as other posters have said it is rarely used, and perhaps a small price to pay for debt freedom.
