Hello,

I have been in my IVA for almost 3 years and unfortunately, I lost my job 4 months ago. My IP has not been helpful at all. In fact, he made my life very difficult. I now have a new job but I seriously would like to make a complaint. Can you help me with that?

Hi Jackie,


To complain about an insolvency practitioner you need to find out which authorising body they are registered with. This should be given to you by your IP.

You should first make your complaint in writing to your IP. If you are still not happy then write to the authorising body for your IP.

There is a useful leaflet called "How to make a complaint against an Insolvency Practitioner". You can get this from the Insolvency Service or Phone The Law Society (0870 606 2500)

A word of caution
I have been itching to complain about my IP and even wrote to the IPA [Insolvency practitioners association] with a view to make a complaint.However I did not name my IP and have not followed through with the complaint.Reason is that an IP can fail your IVA[if you are more than two months in arrears etc] without consulting the creditors and I felt that,out of spite and the fact that they have "got"their money[like you I have been paying for nearly 3 years]they have no incentive to let it go the full term.
There is a post on this site from someone who is fighting off bankruptcy because an IP failed their IVA [for apparantly little reason].
My advice Jackie is to finish your IVA and get your certificate of completion THEN complain about them.I know that this is not the "right" thing to do but first and foremost you MUST look after your own interests.
I am convinced that there are many IPs who do not act in the best interest of the customer and are only interested in how much they are going to earn.The whole industry needs stronger regulation and one day this will happen.
