Well that is where Synergi and other companies are going wrong.They are working back to front,stating what your disposible income "needs" to be rather than finding out what it actually is.This is where people start an IVA and find in a few months that they cannot cope,however because they have paid 6 to 12 months already Synergi and others have enough money in the pot tocover their costs and more.
Its wrong and should be stopped by the regulating body[s]

just one thing missk make sure that your job is not affected by BR if you choose this route.

Good luck with everything, give synergi the big heave ho

Thanks to everyone who has fed back. This is a real eye opener and after speaking to one of the advisors from this site, have decided the bankruptcy route is my best option. I will keep you posted on how I get on and look forward to nights where I can sleep again.

I have decided that the best option is bankruptcy as I have no assets and am not a homeowner. I have requested an application form from the High Court today. Pretty scary stuff, but know this is the best option for me. I need to clarify that it won't effect my job as a PA or my rented accommodation which I share with one other...

hello missk, you may need an appointment to petition for a BR. Conatct your courthouse and find out if you do. As for your employer, they will not find out about your BR. Human Resources will receive notice from HMRC though telling them to change your tax code; and that is all.

As for your rental. Your OR may contact your landlord to confirm what you pay monthly and whether you are in arrears. You will need an Assured Tenancy Agreement or something in writing to give the OR. You will also have bank statements proving what you paid monthly. The free ASTs can be downloaded off the internet if you require one.
Not all ORs check with landlords. Mine did though.

You can get an application online at the Insolvency site and there is a helpline number there as well to assist you. Here is the link:http://www.insolvency.gov.uk/

You can fill it in online and print as many copies as requested by your courthouse. The fee is £485, cash only.

Good luck. I know it feels scarey, but it isn't. I've been there. I petitioned 3 April 2007.

Great thanks this is helpful. I have a tenancy agreement and proving my payments over the last 12 months is not a problem. I'm still clouded about how much I will have to pay and how long for, but this will all no doubt become clear in time..

What you will pay will be a percentage of the surplus income left after you have completed an I & E. The OR has a table s/he uses. They can take anything from 50-70 % per month for 36 months. Even though you are discharged after 12 months from the date of your BR you continue paying into the IPA
(Income Payment Agreement). The remainder is your to spend or save as you wish.
