HELP we have been in aniva for 12 months approached by jefferson hobbs who sent a guy round last night who said best way to go is file for bankrupsy out of pressure we signed with them paying £240 a month for 16 months for them to help us go bankrupt and get us out of our IVA after reading this im thinking we should cancel with them and stay in our IVA or file for bancrupsy ourselves we have no assets so would this be an option any help would be gratefully recieved x

Norbs, welcome to the forum.

I do recommend that you cancel immediately! You can go bankrupt yourself for just the court fees.

I would speak to your IVA company about this if you are having problems.

Stay with your IVA if you can afford it - it will cost you less in the long run.

Norbs - fully agree with Kallis. If you have the energy i would also contact Size5 (on here) perhaps run off a quick email - mentioning what was promised /said. It may just stop this happening to someone else

I know the sort of pressure these companies put you under - you should never agree to anything they offer. Did they mention to you that you maybe subject to an income payment agreement? I don't know whether or not their fees would be included in any outgoings!!!!

Agree with Ginger that you should contact Size5 to let him know about this.

Norbs - bear in mind as well that your credit rating will be shot for a further six years from the date of bankruptcy.

Norbs - the fact you in an IVA - means there is disposible income (although maybe very tight) i can imagine the OR/court would want this a at least.

Act quickly - i believe you would have a "cooling off period" to cancel the agreement and ask for the refund - do it today by email and follow it up with a recorded letter.

I'd speak to your IP first and foremost, and explain why you are £240 short this month. I'm sure they will be very supportive and relieved that you are seeking rounded advice before choosing to fail your IVA.

thanks guys im gonna ring them , email and write they cant say they havent been notified then although not actually making a payment until july they have our bank details ,iva details etc which is a bit worrying yep agreed think its best to stay in the IVA and continue on x thanks for all your advice

Did you sign up for a DD with this company? If so then cancel it as soon as possible.

Norbs - check you bank on line(over the next month or so and any DD/ or S/o cancel there and then - Let you Bank deal with them if a DD is wrongly paid - and ask the bank for an immediate refund (under the DD terms)if this happens
