In theory yes Foggy, however proving it maybe more difficult. With cases like this, it really is important to get all the facts and of course the role of the job offered is vital. Some roles will not accept employees in an IVA and this should have been made clear at interview stage.

If a recruitment agency is involved, the "new" employer will have to go via the agency in the first instance.

I hope common sense prevails here and I will be happy to help if I can.
