You would be surprised about how every area of your life might use this.
IVA started March 2011, Completed March 2016 and certificate issued 11 days after final payment. It was not always easy but then some of the best decisions aren't.

In my mind implied consent is of the medical variety and this doesn't seem the same - implied consent is positive, this is negative because someone has forgotten to do something. But an interesting concept all the same and finance and medicine are different (as we know they dont go together well, lol)

All you IVA providers must be livid seeing the inappropriate way that Creditfix are conducting themselves! 23% fee by any means wtf....

I'd love to know what you guys in the industry are doing about it?

We put this in our letter to them (no response to date):

Your letter 07/01/15 and the proposed resolutions that you have asked us to support raises more questions than answers which ultimately requests' us to:
• Provide consent for the extensive secondary use of the data that we have provided at your/Creditfix sole discretion and
• Provide consent for certain changes without clearly identifying the financial consequences, charges or sharing of information with third parties

Could you please note – where information is provided to yourself/Creditfix it is provided solely to support the administration of the IVA and where Creditfix or yourself is regarded as the direct/joint data controller. We would not expect information to be passed to any third party without first seeking explicit consent from us.

Information that we provide may not be used to populate contact databases etc. that could be subsequently sold to third parties etc.

Additionally we would not expect information to be shared with the following (despite the fact that they are trading names of Creditfix):

DEBT MASTER DIRECT
EIC
Expert Insolvency Claims
FREEDOM MONEY SERVICES

So hold on a minute, I'm sure my new T&Cs from CF did state I have to sign and send back ! Hence why I filed it in the bin..... So they can't automatically change my T&Cs ...... I have all my official paper work all signed and copied from PJG. And that's THAT !!

Ive doubled checked mine and no mention of time scale for return or implied consent if i dont. It clearly says if i agree sign and return in envelope. I dont, i havent and im not going to.

Your might of, ours did but it looks like they are changing the wording with new people they approach based on the experience they have had.

Yes I can confirm that my T&C begging letter did state that if I received it via the post, that I had to sign and return. So no dirty (15 days) tricks with me

So, I'm right in thinking they are trying on on with us? My husband has just got home, read the letter and said he's not agreeing to it.
Is there a standard letter I can reply to them , saying that we don't agree to it? I'm not too good at this sort of thing![:(]

Just ignore it. or scan (or take a picture of it with your phone) and bin it.

They most definitely are trying it on! It stipulates 15 working days or they assume we accept the variation, my husband has just done the same Princess Prozac, it won't benefit us so we won't be agreeing either but will send both a letter and email to confirm this so nothing can be 'assumed'. Such a shocker! Not what you need first thing in a morning!

doritos, if CreditFix are now including a 'implied consent' clause in their letter it may be best to respond stating that you do not agree to the variation.

I have no doubt that after protracted legal wrangling the 'implied consent' would not stand up in court but it would be far easier to make your position clear from the outset?

My letter does not contain this clause (one of the earlier ones I guess!) although I would not be surprised if CF don't bother checking whether I've given agreement and signed before proceeding.

They seem to be horrendously slap-dash with poor attention to detail, an absolute joke of a company.

I don't trust them to run a bath, let alone my IVA!

You should not ignore this letter ... send a letter back confirming your non-agreement to the changes ... register post it so you know they have to sign for it and it gets received.

I personally would return a copy of the letter writing across it in bold lettering that you do not agree and keep one for your file too. As Luluj suggests maybe recorded delivery too. Or scan and email much cheaper with a read receipt option.
IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.
