Was wanting to avoid bankruptcy. Esp after having an Iva. Dont see why I should to be honest. Its been a hard slog considering it should have ended January 2013.

I am in contact with the breach team. I have gone through an income and expenditure. The case is apparently with the completions team. I am just waiting for my pay slips so.i can send them on.

The shortfall on.my property has tripled my debt. So don't know what else to do.

I think at this stage you are doing everything you can to try and make this work - you are supplying all that is asked and lets hope DFD can find a way to end the iva in a positive way rather than cause you further anxiety. Keep Laura informed and email her direct if you need to - don't give up hope !

Update. On post. I have been in contact with dfd. They are saying I should have 299 pounds surplus income. I have just had my council tax bill gone up £8 per month from.original. I told dfd I would be able to start payments at the end of April because I had to move in October and needed to borrow the money off.family. At the.time I was on minimum wage on agency work. Started a regular job in November so just getting back on my feet. Received 2 letters yesterday dated the same date to inform me that dfd are closing my Iva. I haven't spoken to them yet as I have just come out of hospital after surgery. So will prob end up on sick pay. Would never recommended dfd to anyone after all these years they aren't even trying to help. They are saying that the creditors will want me to go bankrupt. Sick of worrying. An Iva was supposed to stop all this.

That's tosh ! You have lost the house, you have nothing to give in bankruptcy. Mind you I guess the silver lining would be that the creditors would pay for it rather than you !

What's the next step for me. Looks like my Iva has failed. Now in my 10th year. Twice the length of time I signed up for. What a waste. What happens with the money I have paid in over £28k

Some of the money you have paid in will go in fees and the rest against your debts. However, this will be wiped out by the re-addition of lost interest, if your creditors are so minded. They will then be free to take whatever enforcement action they deem suitable. Presumably this will include the bankruptcy being threatened -- which they will have to pay for and, as you have nothing to hand over, this will hopefully see an end to the matter --- although the OR might require up to three years further payments, I would argue that you have paid enough.

I would also consider lodging a complaint with and against DFD.

Thanks guys. I wouldn't know how to do about it. I am so sick of trying to make them understand my circumstances. I am back on my feet and can make payments. Why are they not listening. I have lost everything that made me enter into an Iva. But surely there is another way out other than bankruptcy. 9 years ago I probably should have but why cant they let me make another years payments or 18,months. :(

I feel they have badly let you down and not offered timely help. At the very least they have an obligation to explain why they are taking the action they are and why they cannot allow the IVA to continue. We do not know the full history and there might be some reason their hands are tied -- but they owe you to explain that reason at least !
