You would think that Cleardebt would be responsible enough not to contact my current banking provider wouldn't you! I have contacted Tom O'Connor at Cleardebt and copied in Mr Mond, however they are still maintaining their stance that DRSP (their appointed PPI claims company) MUST contact all creditors, whether they be included in the IVA or not.
I have been visited by a field rep from DRSP, who had a mountain of paperwork that I HAD to sign, basically if you don't sign it all and give permission for them to carry out a subject access request, including to your current account holder, then you are 'not co operating' and therefore threatened with failure of your IVA.
As for contacting Virgin Media, seems mad to me, however, you MUST sign all paperwork they bring to the somewhat pointless home visit. The field agents reply to my suprise at this was "well you never know, you may have some sort of cover with them that we can claim, and we are very good a getting everything we can". For a 33.95% return of any claim, I'm sure they do go that extra mile!
As I said in my original post, I am a little nervous that if RBS put 2 and 2 together and realise that DRSP are acting on behalf of Cleardebt, which is made clear for the world to see on the Cleardebt website, then they will suspend my banking facilities. I have highlighted this to Cleardebt and asked for some assurnace that if they insist on contacting RBS, then they be held responsible for clearing up the ensueing mess! However, they are not interested.
Mel's post only goes to reinforce my concerns that banks can, and will, where a customer is in an IVA, withdraw their services.
Hopefully Cleardebt will take on board the comments of those concerned by their current practices and look again at how they deal with PPI.
