Andy, I know cleardebt go OTT on a lot of things -- but that is going too far. To be contacting all and sundry, without authority is surely not allowed.

I agree Foggy, talk about using a sledgehammer to crack a nut! I'd be furious if someone contacted my bank without my authority and as for contacting Virgin Media! Since when would you have PPI from them?!?!

Surely there must be a way of complaining about this?

Reading the terms and conditions on the halifax accounts it says if you are no longer eligible for the account they can close it giving 2 months notice. Basic bank account states that accounts are not available to people in Ivas. Guess its only a matter of time before they close my account. Will be trying the Coop asap.

this seems a tad irresponsible of cleardebt and I would think an email to their CEO David Mond, hi lighting the issue this will cause customers of the likes of Lloyds / Nat west etc , would hopefully see the practise of contacting debtors current banking providers cease

You would think that Cleardebt would be responsible enough not to contact my current banking provider wouldn't you! I have contacted Tom O'Connor at Cleardebt and copied in Mr Mond, however they are still maintaining their stance that DRSP (their appointed PPI claims company) MUST contact all creditors, whether they be included in the IVA or not.

I have been visited by a field rep from DRSP, who had a mountain of paperwork that I HAD to sign, basically if you don't sign it all and give permission for them to carry out a subject access request, including to your current account holder, then you are 'not co operating' and therefore threatened with failure of your IVA.

As for contacting Virgin Media, seems mad to me, however, you MUST sign all paperwork they bring to the somewhat pointless home visit. The field agents reply to my suprise at this was "well you never know, you may have some sort of cover with them that we can claim, and we are very good a getting everything we can". For a 33.95% return of any claim, I'm sure they do go that extra mile!

As I said in my original post, I am a little nervous that if RBS put 2 and 2 together and realise that DRSP are acting on behalf of Cleardebt, which is made clear for the world to see on the Cleardebt website, then they will suspend my banking facilities. I have highlighted this to Cleardebt and asked for some assurnace that if they insist on contacting RBS, then they be held responsible for clearing up the ensueing mess! However, they are not interested.

Mel's post only goes to reinforce my concerns that banks can, and will, where a customer is in an IVA, withdraw their services.

Hopefully Cleardebt will take on board the comments of those concerned by their current practices and look again at how they deal with PPI.

hi there

ive just done a companies house check and clear debt & DRSP Ltd share the same address..... im assuming this means Clear Debt own DRSP; what a nice cosy win win situation they appear to be in. Looks to me like ther are more interested in lining their own pockets as opposed to looking after you as a client ? Just my view and im sure someone will be along to fierecly defend Cleardebt

Although I am not involved in the ClearDebt side of the business and don't think it is appropriate to comment, I can confirm that DRSP is not part of ClearDebt. Before anyone starts accusing anything and making assumptions with negative connotations which is not fair think it be only fair to allow someone from ClearDebt to respond. This forum is a place to raise questions and get responses based on experience of an IVA or from experts in the industry, not a site to castigate.

I have given David a nudge and he has advised he will look in to this and respond to you all shortly but in the meantime, think it be fair that insinuating ClearDebt are wanting to fill their pockets ceases.

i stand corrected Samuel, however both show the same address at companies house, which does lead one to think there may be some form of association , link or call it what you will, hence my earlier comment

At least my post will have brought the issue the other forum members have raised re DRSP writing on behalf of Cleardebt, to their current banking providers and so alerting them to IVA activities, to the attention of their CEO David Mond

I also stated that my comment was mearly my view & expected someone to defend Cleardebt and this is exactly what has happend

Clearly in my post i stated " im assuming " and from what you say Samuel I was incorrect. Whilst accepting your comments "not a site to castigate " , its important to note that the forum is a place for discussion , comment and opinion and my comments were obviouly thought provoking and as i stated " just my view "

Isn't it about time that the governemnt stepped in and told these banks to start supporting people instead of causing more concern to the people of this country. These banks were helped out by the government. I think the govt should play a bit of hardball with these banks and tell them if you stop offering these accounts and carry on closing these accounts then we want our money back now. That would make the banks be a bit more sympathetic.

Their CEO David Mond is already aware what DRSP are doing! I told him and Tom O'Connor two weeks ago. However, the replies I have had from them still indicate that, although RBS are my current account provider and I have no other accounts with them, they 'MUST' be contacted as part of a PPI investigation, which 'MUST' be carried out by DRSP. Over a bit of a barell really with only one loser in the long run . . . me!

Please don't treat this as having a go at ClearDebt. I am only using this forum to share my experience of DRSP and the PPI claims process operated by ClearDebt, so as to inform potential customers so they know what to expect.

12 months to go. Many companies share addresses for service. Many are accomodation addresses, or virtual office space, so we cannot infer any connection between companies sharing addresses.

I am not, in any way, defending ClearDebt, in fact I agree that this particular practice is way OTT. However, as Samuel rightly points out, we are here to share opinion, support and discuss. I, myself, have voiced opinion that some IP's might be tempted to harden their attitudes to maximise fees (especially in light of the current trend to make fees percentage based).

But, let's please stop short of levelling accusations directly, especially those based upon assumption.

Thanks Foggy. My posts are no way based on assumption, they are based soley on fact and are as a result of numerous emails that have gone back and forth with ClearDebt, all of which I am more than happy to share the contents of on this forum should the need arise.

The sole director of DRSP was a Director of both clearcash & cleardebt until 31/5/11 when she resigned. She is currently a director of 2 companies that one of the Cleardebt directors is currently a director of also ( note not in the cleardebt group ). She has also been company secretary or dircetor for other companies in the past that this same Cleardebt Director has been a Director of.

I Fully accpet that Cleardebt do not own DRSP as i previously supposed may be the case. Whilst there is no legal entity connection, there is certainly a link between the DRSP sole director and one of the Cleardebt directors with other companies not associated with Cleardebt ie they are Directors together in other companies, but not DRSP or Cleardebt

I accept my earlier post was perhaps a little harsh, but thought if I go in and edit, this would then make Samuels post seem a little strange.

So DRSP have no connection with Cleardebt from a company ownership point of view, but the sole director is currently involved in other companies that one of the Cleardebt directors is, but there is no connection between these companies other than individuals having interstes in other companies both historically and currently.

Yes companies can share office buildings and im sure DRSP being in the same building as Cleardebt and run by one of their former directors who shares directorships in other companies with one of the cleardebt directors, whilst not having a direct connection with Cleardebt, has an indirect connection. Gosh what a tongue twister and still thought provoking !

the basis of this information are the public records on companies house and various other websites that take info from companies house
