i was made bankrupt 3 years ago. for an estamated self assesment. for 2200. the trustee. now has a possesion order on my family home. the bill now stands at 35000. ??? can you? if possible. give me any legal advice or knowledge on any rights. you think i may have. i would do anything to keep my home... im at the end of my tether. feel like my fighting battle. is over. n im about. to lose. everything... thanks

Hi Sharon

I just wanted to welcome you to the Forum ...

What a worrying situation for you ... do post a few more details, such as how much equity you think you might have in your home etc. and I am sure that the experts here will be able to give you some good advice.

Might I also suggest that you contact Paul Johns (posts as Reviva) as he is a bit of an expert in the bankruptcy field.

Hiya and welcome to the forum.
If the figures are right that is one hell of a hike. I know they apply interest charges and have heard some horror stories about huge increases on property like this.
I wish you luck in getting it sorted and expect one of the experts will ba able to advise you or point you in the right direction,

The trouble with being made bankrupt for a relatively small debt, is that the charges and costs of the Trustee and the Official Receiver become absolutely disproportionate to the debt itself. This does sound an awful amount to have to pay, though, and has the Trustee given you a break down of how those costs have been calculated?

i'll give a bit more of back ground to the story.
in 1997 i was self employed hair dresser and had been since 1990,i always did my tax returns myself.
in 1998 i sold my shop and went to work for someone alse in there shop. i told the tax that i was no longer self emloyed.
ithought that was that.
at the end of the tax year i was sent a self assesment. i rang the tax office and told them. they said ok and they woild update my records.
a few months later they sent me an estermated tax bill for £2169 for that year.
i went in to the tax office to sort this out.
they said that it was an estermate and that they had no record of me ringing in and telling them that i was no longer self employed.
i told them who i was working for, it was only part time for two days a week and i was not self employed, it was for a local shop.
This went on for a while, they would send me a bill reminder, i would go over to the office and they would say it was automaticaly sent out and they would sort it out.
then one day in 2003 i got a visit from someone for the recovery deptment.
they said that i owed 3 years tax returns.
i went through all the stuff yet again and had to sort it out.
the recovery didnt want know basicaly.
aventually i got most of it sorted apart from the estamated year which was already with recovery.
during this time a had alot of family probs and illnesses, but i still tried to sort it out the best i could.
in 2005 i got another letter saying owed the £2164 again and the three years tax returns again( which wasall sorted two years erlier).
Got the three years off mt record again, but they said i owed the £2164.
I went back to the main tax office, they said that they had records of me working for someone, and i should not have got the essessment.
I thought that they were going to sort it out. insted i kept getting letters from recovey, when i called them they said i had sort it out with the office. when i called them they said it was sorted.
this went on and on.
in 2005 i got a letter sayng i was getting a forced bankrutcy order made against me.
i thought that would mean i did not have to pay it and didnt really know what it ment.
then i got a letter from my trustee asking for records of my estate.
that was july 2005, by nov 2006 the bill had gone from £2164 to £25,380 in less then a year!
i was total depressed and could not belive this!
i got an accountant who said he would sort it all out.Thougght it would be ok and get it sorted out.
He did nothing really.
i got a letter a few months ago to say that they were going for possetion of my house, my husband did not know about this or the massive bill.
My acountant tried to stop them by saying that i didnt owe the money in the fisrt place and was tring to sort a meeting out with the inland revenue. but thay just put the court case back a few weeks.He also said that by time the new date arrived h would sort it out.
the long and short of it was he didnt.
When i found out the case was being herd i flew through to tyhe court on my own, i could not get i touch with my accountant (found out now that he was in america).
i tried to tell the judge what had happend over that last few year, he would not even let me speak, there was no duty solisitor availible.
he said i had to give up vacant possession on may 6th 2008.i wasin bits, the trustee's solistor told my to get a bankruptcy solisitor to gte help.
My husband got a letter a few days later telling him .
we went to see a solistor and was told they would help us.
They said we would have to remortgage to pay the £25k off.
We also went to see the trustee, she said that th bill had risen to £32k. we told her that i didnt even owe the money in the frist place. she said that we had to pay it then after try to sort the tax out.
We got a remortgage sorted for the money, then our mortgage adviser got a last minute email saying it has risen again to £35,500.That wason may 1st
I just cant belive this is happening to us.
We have been in touch with our solisitor on the same day.
we complained about the last minute hike in the money.
Thay sent us a letter that day stating that they also do work for our trustee and would not be able to contest any prob with the bill and did we want to go on with the annulment.we then rang our trustee who said it was further intrest and if we did not pay it the house would be going up for sale on the 6th of may.
i cant belive this is happening.
we have sorted out the mortgage now and sign on monday.
our house is worth £115,000 , we have £29,000 mortgage.
the bill is 920 petition cost,1564 o r balance,1950 legal costs,160 disburtsments,12415 trutees remunaration,500 future costs,12200 inland revenue costs, 40 c c costs.
plus another 3300 dti and further intrest.
feel like i am slowly cutting my own throat!

My goodness Sharon ... you poor thing! This is crazy ... and so worrying for you [:(]

I can understand though, HMRC can be a nightmare and are a complete law unto themselves. I am dealing with a F&F offer to my creditors at the moment and HMRC put in a a claim for £4500 at the last moment ... I didn't owe it to them ... indeed they actually owe ME money because I paid too much tax last year. My IP asked them for proof of the debt which they didn't produce ... so essentially they just put in a figure that came into their head.

I do hope that one of the experts here will be able to give you some clarification ... in the meantime, please be assured that you are amongst friends here who will help and support you through this.

hi sharon, you have come to the right place for some advice and the experts will be along to help you all they can, they are marvelous, what an absolute nightmare, i cannot believe that this can happen to someone, it is awful enough being in debt and worrying about legal action when you do owe the money, but for you this is crazy as you dont owe them a penny. did you not have anything in writing from them at any point to say they were sorting it out or that they had records of you working for someone else and therefore not s/e, that might help your case.

Good luck Sharon i hope you can get this crazy mess sorted out soon.

thanks to all that sent messages last ... your kind thoughts mean a lot at the minute...never slept. had a really bad night... just hope someone in bankruptsy/insolvancy. can advice or help me soon... cos havent got long... n the power these people have!!! is unreal... they not bothered...about my mark(husband)n me girls(kids)... sharon... help???

hi debbie thanks for your message earlier... i just read it now... cos tried to stay off the computer. today... try n get my head round things... feel like im going crazy... i no... i realised i was on iva site... think they pretty much the same... i mean. professionals. on there. might be worth a try... thing iz. it takes me that long to do anything. on the computer... lol... well serpose im doing ok... considering i couldnt even turn one on... lol. before all this came to an head... even though all me family are users... lol. thanks again debbie. take care.
