SORRY IV JUST GETTON BACK TO YOU... just read ya last message...
its okay if ive already said about stuff... ITS SOME STORY... a lot for me to take in... never mind... someone who dont no!!!
on receiving the letter that the trustee was going for possesion of my family home... in which i new was near... n was to happen... prev meeting a long time ago... IT WAS LAW... he said. thats when i realised how bad my affairs had got... AM NOT VERY BRIGHT AM I.
i had a guy from account and taxastions trying to sort the revenues bill theyd actually got the bankrupsty order from... he was waiting for a meeting with the revenue... to see how the assesed bill had been sent to recovery in the first place. as the main tax office had details off me working for someone n not self employed... in the mean time the letter came with date for court hearing for the possesion order... mr doshi from taxasions who was sorting the tax out said... things should be well sorted before the hearing. n if they werent it would be agourned... as my trustee was aware that we were waiting for confermation from the reveue...
three days before the hearing. i tried to contact mr doshi to see if hed heard anything... i was in london my self that week... n left messages on hiz answer phone. i also rang my trustee. he was unable to take my call. as he was on holiday that week...
on the day before the hearing i got home. had a really restless night. n was up with the birds...
i tried to ring mr doshi from 8.30. still hiz phone just on answering. so went over the office. locked up...
came back home n rang trustees office... thinking. to make sure. the hearing was agourned... to be told that my trustee had passed my case over to another trustee 5 days prior... on speaking to her. she didnt no me. she had my file. she said the hearing was going ahead... there solisitor was attending... n they were going for possesion... i had 1 hour 10 minutes to get ready n get down the court... i had my kids off on school holidays...
IT WAS A NIGHTMARE... if you had read my text earlier today. on court date...

had my house valued at 124k ...
we thought 115k...
we have 28k morgage

so lot of ecquity... int it... we have no other depts... £££

had a meeting with new trustee. she is lovely... only doing her job... she said at the last meeting... if shed met me n my mark prior the court hearing. n realised. our situation. she would have agourned the court to later date n give us more time... !!!

by the way ian... mr doshi from taxastions was on holiday... in florida... he rang me later that day... on getting my messages.!!!

Thanks Sharon for your kind words.

As Melanie says, ring Gill or her daughter Joanne tomorrow - you need someone batting for you at ground level.

A possession order is one thing, an eviction order and the bailiffs turning up is quite another. There are things you can possibly do in the meantime. If you can get the possession order temporarily suspended you can investigate a remortgage or some other means of raising the money. If you were to raise the money in that way, would you be able to afford the payments? That is a vital point. Let me know please, as I may have the seed of an idea.

hi ian...
i will def be ringin tomora thanks... cos not got long... if i dont raise the cash soon... thats wot will come next... i dont think ive another choice... n carnt n wont risk losin my home...
as fair as being able to afford to remorgage... well we would be able to afford a higher monthley payment... well it would more than double... even if we had to do without or cut down on other things... we would have to.
i only work a few days at the minute. but looking for a job with more hours now...
im worried sick about the insolvancy lawyer n his bill he could throw at me... when i first rang him. he did say he charged 232 £ per hour... n then said at the last meetin 1800 to do the annalment... n all services or time he expected cash up front.!!!

we only pay £261 a month morgage...
always had cash in my purse to get by, get the kids there needs n wants, n a holiday n stuff... no credit.

i think ill be able to get some sleep. i feel really relaxed. mind iv never slept in 58 hours...!!!

Yeah it is a small world, there's a few of us Makems on here. [:)]
At the risk of sounding cynical, the fact that there is so much equity in your house is the reason the OR is pushing so hard for a possession order. They know they will get their money if it's sold. If there had been no equity they would not have been interested.
Make sure you make that call today, you need someone with a bit clout on your side to advise you and/or contact the OR/courts. Please don't be afraid for Gill to contact the OR on your behalf. From the sound of it, things can't get really any worse and any effort to change things is worth it,

Hi Sharon

Last night I referred to a possible idea. I am now in the office and have had a word with someone at one of our sister companies that does bridging loans, which are far quicker than remortgages to obtain and I throw it in as something you can consider, on the basic assumption you are discharged from the bankruptcy. Basically you would pay off your mortgage and release equity from the bridging loan to get rid of the trustee and would then remortgage probably 6 months later. On the assumption you have demonstrated you have been able to pay the bridging loan for 6 months the remortgage ought to be that bit easier.

The basic criteria are:

How much do you need? Typically it can't be more than 75% LTV (so you are OK on that score based upon what you say).
How long? 6 months seems the optimum.
There definitely needs to be an exit route, it's not a long term option. Therefore the bridging company needs to be happy that by the time the bridge comes to an end, you will be able to have the remortgage in place. As a result you need to show you'll be able to afford the remortgage.

As you will expect there is a cost element involved. I merely draw your attention to the fact that the option exists if the overriding priority is to keep the house, and there is no other way of raising the money within the necessary timescale. Mention it to Gill and see if she thinks it's worth investigating.

Not to worry about Gill, she's a straightforward person. I'm absolutely sure she will look after you.

She's in Knaresborough, North Yorkshire, which I believe isn't too far from you. I understand she's from Sunderland too so that's not a bad sign.

I have to say though I think when you have come through the other side please keep posting. Behind that "stress head" I think there is a very strong person with a terrific sense of humour. I think you will able to offer a lot to this forum.

Certainly anyone who thinks Bankruptcy is the soft option would do well to read this thread. I think if I was in Sharon's place I'd be a stress-head too, I'm bad enough as it is! All this going on and yet more mouths to feed??

Sharon, if the Mr Doshi is the same one I'm thinking of, keep with him. It's a complete mess but you need someone who can see past all the gargon and legal speak to help you out.
Try not to stress too much, I know it's hard at times but you've got to stay strong and focused to try to get this sorted,
