I received a nasty letter from M&S today so i called to let them know i am going BR and what date my appointment is.
Just before putting the phone down he asked me if i was still a homeowner and i asked why he wanted to know - he made up some ridiculous story about me struggling then he can give me a number for advice on mortgage arrears. i told him this had nothing to do with my loan and made it clear that i do not pay the mortgage and it was only my debts that were causing problems.
Has anyone else had this from crediors and it sounds like they are going to try and put a charge on the house ???????????
I have to say that a friend of mine works for an agency that chases debts by phone and he has explained to me that part of his job is to try and glean from people, via seemingly innocent questions, whether they are homeowners or not so that, if they are, they can either threaten charging orders in order to obtain more money, or indeed to pursue them.

This sounds like not a another rueful call but a 'M&S' rude awakening call.These questions can be somehow used to make an unsecure debt to a secure debt.It is a leading question and MBNA asked me the same thing before I my IVA.
Changes of legislation in C.O have now made them quicker and easier to implement above 1K of debt...a complete antithesis to the banking code in treatimg people fairly.

Goodness me, will they not be happy until we are all bankrupt??!! Surely they get more money from and IVA/DM plans so wht employ thesetactics.
Seems the saying things will get worse before they get better, rings true!!

The thing is i am going bankrupt - on the 13 October.
Im so worried they will put a charge on the house before then, but is it right that they have to go through certain procedures to do it. In my case they only have 11 days !!
Surely it would take them longer than 1 week - even if i had not of told them my plans (really wish i had kept my mouth shut) dont they have to give me a set time to reply to any letter?
