Finally heard from our ip after being given the run around for a while with telephone calls I finally got hold of a sensible person who is now keeping me informed and seems to have got things moving - they say the offer is a good one and they have drafted the report and set a date for creditors meeting of 29 Nov so fingers crossed it will be accepted - i will post the outcome - excited but nervous![;)]

Marvelous news! full and final accepted and had a mortgage offer so all systems go. we are over the moon that we can finally be free of this iva and get back to normal again but needless to say we will never be so stupid with credit after this experience! Thanks to everyone who gave advice and merry xmas![:D]

Its all going horribly wrong!! We are meant to be completing the remortgage this Friday but everything seems to be against us. Our offer of £25k was accepted and on the advice of my broker we arranged a remortgage of slightly more than the offer to ensure that all fees were covered. As this was rounded up it meant there would be a small amount from the remortgage left over. Only on the assurance that this money would be ours and not part of the settlement did i agree for the broker to do this. My IP has written to the solicitor stating that they require "full proceeds of the remortgage less fees of approximately £23,900" (£25k less broker fees). The solicitor is saying that this implies that after fees the balance of the remortgage should be given to the IP. The solicitor has spoken by telephone to the IP requesting that they put an exact figure in writing to settle but they are refusing to change their wording. I do not understand how they can do this now when no mention of this has ever been made before. Nobody (especially the broker)warned me that this could be a possibility as I would never have agreed to round up the borrowings in the first place. Can anyone help? Can the IP do this? surely if they have accepted an amount in full and final settlement they cannot now be expecting to receive more than this? Sorry this note is so long, feeling very stressed now as we were so close to finally ending this bad chapter in our life and now it seems like it could all go horribly wrong and we could be worse off than before.

It depends upon the wording of the resolutons passed at your creditors meeting. Could you post these here so we can advise further. You will find these in your Chairman's Report of the meeting proceedings.

The chairman's report had the same wording "full proceeds of remortgage approximately...)". But this was not my offer and this has never been mentioned before in the conversations I have had with the IP when going through the process of making an offer.

Then you need to sort this out directly with the IP - as you are into a "he said, she saie" scenario.
