Evening all...I could do with some assistance and to know whther anyone has had this approach from MBNA.
Last night I had a call from an Irish Woman telling me that I neede to get them paid upto date. She gave me till this evening to contact het and she advised that she would be my account manager from now. She also linked both my wifes account and mine together.
Tonight I was in the bath when MBNA called again and my wife advised I would call them back in 20 mins. After the 20 mins I called the lady back (a different lady from the night before) and this lady now advised that she will now be my account manager. During the conversation I advised that I intended to apply for an IVA. Upon stating this she said that MNBA would not accept that and that as they were a big creditor they would cause it to fail (About 25% of the debt). She advised that an IVA would cost me about £7000 and that when they refused I would be left with a bill for £7000. She explained that I should agree short settlements with all my creditors and that she would write the debt down by 60% NOW. I explained that if I could get the funds then I would and that I appreciated the offer. The lady then got quite aggresive and said that if I did nothing then they would send it to Legal & Fraud tomorrow. Then she told me that if paid both my wifes arrears and my own she would hold off any further action till next month. I explained that I was unsure how I could possibly make the payments and she advised she would take either Debit or Credit cards. I advised that I had no facility and no credit cards to pay from and explained that this would simply make matters worse. She then gave me till 12.00pm tomorrow to clear the arrears or it will go to Legal & Fraud. Also she said that when applying for an IVA it was still a requirement to make payments to the creditors whether they are full payments or just tokens.
My questions are
1.Has anyone else had the "Legal and Fraud" threat
2.I thought that making token payments etc would make no difference.
3.If the debt would take longer than the 10 years mentioned by Melanie to clear are MBNA likely to accept the IVA.
Any help would be appreciated.
did you get the name of the person you spoke to as this is harrassment in its extreme. Next time ask if she is sat down because she is going to get a great kick up the A*** and the chair might just protect her a bit.

If the debt would take over 10 years to pay under a DMP then they are likely to accept.
As for the call centre staff....well....IGNORE them, they work on a commission basis and will try anything to make you pay.
It is entirely you choice as to make token payments or not. It will make little difference to the outcome of your creditors meeting.
If you are planning to go down the IVA route and have not already chose a company to act for you gthen may i suggest you take a look at www.iva.com. There you will find a list of companies and reviews on each.
I would also highly recommend either Melanie Giles or David Mond who post on this forum. You dont get much better than these guys and they have a lot of positive feedback from other posters on the forum.
Hi Confused.com, I've had the tactics you have described above, although not agressively, but I am getting daily calls to which I have now signed up for the BT 'Choose to Refuse' service that someone else recommended.
My advise is to get an IP immediately and find out if the DMP or IVA is your best option. I am in the same position that MBNA (haha the responsible bank as they stated in a letter to me) is my major creditor so I will let you know my outcome.

When you answer the future calls and you establish who it is before your confirm it is you on the phone - simply say "sorry he isn't in at the moment and put the phone down"
Alternatively when they ask the security questions give them false answers then they cannot speak to you regarding your account - if they do they are breaking data protection and could be liable !

Do not let these bullies get to you because that's all they are. They just want to bump their wages up by getting commission if you pay.
They will lie to you and threaten you.
Just remember that these are call centre staff and have nothing to do with voting in an IVA and have no say in what happens at all.
The other thing you can do is to refuse to confirm your details when they phone - they cannot proceed with the call if you do that.
Ignore the threat of passing it to another department - that's just a threat as well. It's not a requirement to make payments - I made non and my IVA was accepted.

they usually ask for your date of birth. As I said to Lloyds TSB I couldn't remember being born so had forgotten my date of birth. They will terminate the call at this point.

A lot of the information you were quoted is incorrect - and David Mond I think will be interested in your post as I believe he is taking up various matters with MBNA shortly on behalf of the Debt Resolution Forum.
MBNA do accept IVA proposals - and if they did reject you would most definately not be left with a bill for £7,000 for IP costs. In fact, I would not expect you to be left with any bill for costs.
Thank you all for your words of support. It just frustrates me and I question the management of a company who will let lame brain idiots make statements to people and in turn also give them the power to make quantative write down offers on accounts. I presume that a commission must be paid against the amount which is inexcess of the amount that MBNA would receive from selling the debt. How do banks operate - are they also offering reduced settlements on loans etc?

Confused, do as people on here suggest by answering their questions wrongly, I did it again last night, again with RMA, he asked for the first letter of my mothers maiden name and I just said "I've forgotten it" he hung up on me. I now treat it as a game. The best one was posted on here which is, "What is your date of birth?" reply, "I know I was there but can't actually remember the date",
So just had a call with my new best friend RMA (well they call everyday so they must be my best friend!) Anyway I missed the call and they left a name and number to call back.... So I did!
Now this is the first offensive and stupid call I have had to date, she asked if I was making a payment today, I said no.... her response why are you calling then? I responded because you asked me to call back.
Her response to that was that they don't want to speak to me unless I am making a payment on my accounts in arrears, so I told her to stop calling me then!
Ah.... until my call tomorrow, I wonder what I will have in store!

A woman from MBNA phoned me at work this morning asking why I hadn't paid my cc, I explained my situation and said as this was about the 20th phone call they would have managed to get all of my details on to their computers, she said, "Yes we ahve your details, creditors meeting date etc, etc, but I need you to make a payment today" I said that I wouldn't as my meeting is next week and MBNA would get their share of monies after that, she said she would tell all of her colleagues then they could turn up at the meeting. She also asked why an IVA and not a DMP, I told her that was between me and my IP as I do not discuss personal details with a stranger, she then hung up on me.
Fancy saying that they would turn up at your meeting! What a stupid woman!
