Hello all,
I have read this forum for a few weeks now and have found some of the information offered very helpful. I am currently going through the IVA process and have a creditors meeting arranged for the middle of next month.
I have just had a letter from MBNA again, and for at least the 6th time i have informed them of our situation. The guy on the other end was quite agressive and told that he would rather be bankrupt than go onto a IVA, just wondering if anyone else has had a similar expierence with them. Most of my creditors have been good once i have explained what is happening. I have always notified them of new details and when my creditors meeting is due. But MBNA seem to want it make it difficult.
The operator informed me that there was no way they are going to accept an IVA and i should go on a DMP and what the cost per month would be, and that is my best route. As my mind is set on an IVA, via cleardebt, i told him no thank you.
I think this is part of dealing with my IVA, but why can't all companies deal with it, like most of my creditors have done. Many of them say they will put the account on hold until my meeting. Most of these companies then say that if the IVA is not accepted, they will offer me a DMP with themselves and i have just got to contact them when i know the results.
Still only a few more days to go and i shall know one way or other. We are still smiling through all this, but some companies do try and take you down.
My advice is "keep smiling" [:)]
Sorry if this seems a bit of a ramble
Hi Micky, It has been explained on here before, the debt collection departments have little or nothing to do with the decision on whether an IVA is accepted. They are often commision based staff trying their best to get some money out of you. Many people have their own ways of dealing with this. May I suggest:-
* Change you contact details online if possible
* Don't answer their security questions
* Ask them to prove to you who they are, as you do not discuss finanical matters over the phone
* Change your telephone number (about £25 with BT)
* Don't anser the phone at all
* Tell them at the start of the conversation, that you are recording the call (this seems to put them off)
Whatever you do, don't let it get you down, your creditors meeting will be here soon
My husband was told more or less the same as you. One told him he would not get an IVA because he was too old!! Ignore them. Another creditor - Barclays told him they don't accept IVAs yet look at the number of posts on here who have Barclays as creditors - sometimes they vote sometimes they don't. They will try anything to get money from you! Ignore them!! J
I think the first time you change your phone number it is free with BT.
mickyboy - the call centres who phone you have nothing to do with what goes on at the creditors meeting. They are on commission, so the more people they can bully into paying, the more money for them.
As the others have said - just let it flow over you. You're better than they are!

Hi Micky, yes I have the same, their collection agency RMA is calling me every 2 days and tell me everytime that they will take me to court for defaulting on my credit agreement (always worries me)
But I like the advise here, my just change my number although I get worried that I could be seen as obstructing the process.
Still I don't have a meeting date yet as my IP has only just got all the paperwork.
Approved 3rd June 2009 first payment made on the day.
Offer made and settled - happy days

I had one of my creditors saying, "youre not doing one of those 5 year things are you?" if you are youre insane. They shouldnt be doing this, I dont think its any of their business, its not their money. I think a psychiatrist would be far better at diagnosing my insanity, thank you very much.
Hi,
Thanks for all your replies. I know we are all in the same position. I have taken note from many people on here and the information obtainable.
Tele2002: welcome to the board, you will find many tips on here to help keep you sane. Do not let anyone worry you. I know it is easy to say, but you, like myself, have taken the first road on getting ourselves out of debt. I will say tho, that MBNA (RMA) seem to be the company that are pestering me the most.
As some of the previous posts have suggested, try some the tactics mentioned to deal with them.
tele2000 - the call centres work from a script, they will all threaten to take you to court, but by the time they decided to action that, your IVA should be up and running!

collection depatments have no say they are simply trying to get as much money from you as possible the guy on the phone doesnt own the company hes just at the very bottom of the chain just bear with it and it will end remember... collections dont decide on your iva!!
Hi all. I find the phone calls at home very annoying but I can ignore them. If i did change my number they would still phone at work![:(!]
just phoned aegis because they are constantly phoning and explained that no matter how many times they phone me the result will be the same. my daughter who is 9 earwigs in and I just hope that she doesn't tell everyone what she hears me say on the phone [:)] I am in the same boat as you Mickyboy and am waiting for my paperwork to be looked at and it is very frustrating waiting for the moment of a meeting and hopefully acceptance by the creditors. just wish these weeks would hurry up and pass [:(]
MBNA will only support IVAs if it is proven that their customer would take longer than 10 years under a non fee paying DMP for them and the other creditors to get paid in full.
My parish priest (catholic) gave me a good letter to send to nasty creditor ones. " Dear Sir/Madam, I am in the wc your letter is before me it will soon be behind me, yours faithfully....." I have used it!
