Lisa

The person who spoke to you from Black Horse is quite likely to be a tele-operator who will have absolutely no say-so in whether your IVA is accepted or not.

Please try and remain positive over the next couple of weeks, and make sure you let us know the outcome as soon as you know!

Hi
Just to echo Melanies words.
Your creditors meeting is set,you have done all that you can and your IP states that BH do not have a vote that is 25% or more of your debt.....................so please stop worrying and do not get involved in long conversations with BH,simply state that you have proposed an IVA and you will wait until the creditors vote on it.
As we have said before your IP would not take on your case if they felt that it would not be accepted.
Relax

You have gone with Debt Free Direct who have become selective in who they propose an IVA for. This is GOOD NEWS for you. If they did not expect it to be accepted they would not have taken it to this stage. They only forward a very small percentage of their cases to the IVA stage so in that respect you are one of the "chosen few". Black Horse would prefer to chase debts of £7500 and OVER; there are far bigger fish to fry in their books. I mean they have been offering unsecured loans of £25,000 for years. They must have defaulters who owe five times what you owe and then the rest ! Try to feel better that - whilst your debt is overwhelming to you - it is a small fry in a big ocean.

Hi again Lisa
Nobody thinks you are going on, you ask as much as you want and if you just need to talk about it the forum is for that as well as the technical stuff. Support is what most need whilst waiting for the meeting. I know what you mean about no life we have lived like it for years but at least the end is in sight and will be for you too. Waiting is always the worst but it will soon be over and I think all the comments seem positive so please try not to worry. Regardless there is always a solution.

Lisa, ask as many questions as you want. As the others have said, DFD wouldn't have put your IVA forward if they didn't think that there was a good chance it would be accepted. I know that it's easier said than done, but sit back, try not to worry and let your IP do what he/she is paid for.

Take care, and try not to let this make you ill x

Hi Lisa

I really hope it works out for you. Please do let us know how it goes, everything crossed for you.

Sorry to jump in on your post but this has concerned me.

Melanie, pleased you are back and hope you had a good holiday? Well deserved I'm sure. You are waiting for me to return paperwork etc. and as mentioned to Sarah, hoping to do that this week once hubby returns tomorrow (also waiting on a couple of bits of paper in post). However, this subject has concerned me.... I have two loans with BH - neither of which individually is over £7.5K but combined they are. Also second loan (£3K is 1 or 2 months short of a year old as I took a payment holiday after Christmas). Collectively, they don't equate to even 10% of total combined debt and I realise you haven't had the opportunity to look into our case (hopefully offering 50-55p in £)but I hadn't realised BH took such a rigid approach. BH called me the other day and said they'd made relevant notes on my account and that they were 'happy to work with me following your review of our situation' - did I just get someone nice that day??

Will expedite paperwork coming back to you as this has concerned me. Any feedback appreciated from Melanie or anyone else with experience of Black Horse.

Many thanks for listening...

Hi, we all understand what your going though, although everyones circumstances are different, we are all in the same boat or been where you are right now! I know it's easy for people to say stay calm and try not to worry but that's what you need to do Lisa, DFD have a good reputation so just let them do their job,

I dont have any debts with BH so I cant give advice on comment on that one, MBNA was the worst, I received calls 5 times a day which almost made me cry, nasty letters saying they have passed my debt on to a debt collector and someone will be round if i dont pay the minimum payment of £5.69, they called at work and when i told them I cant receive personal calls they just said not their problem and like kez said I told them i would get the sack and then they would get nothing and they stopped ringing, my other creditors wasnt as bad as MBNA but Morgan Stanley and Sygma and Egg said they wouldnt agree to an IVA they was just trying to scare me just like BH are trying to scare you, But had my creditors meeting last week and they all agreed to it apart from MBNA

Hope this has helped you Lisa, Keep us informed.xx

Hi again Lisa

I've just re-read your original post and I feel really bad now for trying to 'hi jack' your post. I'm afraid my mind clouded over with mention of BH and I didn't really read your problems. [:I]

I too am sick with worry but please, please don't let it make you ill. Having read loads and loads of posts on here in the last couple of weeks, the one thing I'm sure of is that there is always a way out of debt, even if its not the way we originally intended! Unplug your phone (amazing how this helps, even temporarily) and (this is gonna sound silly) go and sit outside somewhere and take in the sunshine. Try and relax your mind from racing around (I know its hard but it helps). My friends suggested yoga and whilst I haven't tried it yet, I might do when it gets worse! I took our dogs for a long walk last night in the woods and this also calmed me (don't laugh!)

Anyway, just wanted to say sorry really. Hubby is away at the moment and it's horrid worrying about everything - especially when you can hear yourself nagging/screaming at the kids!

Hope it all works out.

Best wishes
xx

hi lisa

im 3months into my IVA and just want to say really dont woryy. I was exactly the same as you (worried sick) i had creditors on my back constantly, and one of them imparticular hounded me all the time, they also said they would not accept the IVA , i even got default notices etc......couldnt wait for creditors meeting and guess what it was accepted. Even the one that said wouldnt accepted!!!! Like people say these people are just paid to bully any money out of you they can get, and they do not communicate with each other. In the end i started to ignore the calls.

the best thing was when IVA was accepted (the creditor that said they wouldnt accept - but did!!!!) rang yet again and it was great telling them that iam now in IVA, that they accepted, and goodbye.

i now people saying do not worry,,,,doesnt help alot, but i was convinced my IVA would be rejected and it wasnt. We had debts of £57,000 and we end up paying £21,000 back. we are paying £245 per month now and then when we stop paying child care fees we pay £375, so chin up girl, ignore the calls coz you will just repeat yourself time and time again......hang in there for the meeting and keep us posted.

take care

Jo

Just because one persons IVA was rejected doesnt mean yours will so please try not to worry, your health is more important, there is always a way out of money worries but there no way out of bad health, take it easy, I thought mine was going to get rejected as all my creditors said it would but it got accepted hopefully yours will too, melanie said there is a chance it will be accepted as it's under £7500.00 and not a new loan or something, She is really good on this subject so take her advice and cross that bridge when you come to it, Please dont stop posting so we all know your ok.x

lisa try and chill a bit, i know its hard and its very frightening at the minute, i owed BH £20k that is why they rejected mine out right also it was under 12 months just, they talked me into the loan when i telephoned for help, what my point is i had not paid them anything from july to January, all their threats were empty just scare tactics, and they do frighten you i know, as far as i am aware they donot take action very quickly on their debts even if the iva is rejected, if it is do what i did enter a DMP until you decide what way you will go next or until you try for another iva, as long as you pay them something they cannot touch you, and i had a conversation from a lady in regards to this when she phoned saying they wouldn;t accept the DMp and were putting a CO on my house which i knew was rubbish as they had to have a CCj first in default, i had the upper hand i had acted fairly in trying to repay my debts,i also knew that there could be a possibility that the judge would throw the CCJ out when he seen i had nothing else to give over what i was already offering. and BH would lose out again.

what i am trying to say lisa there is solutions, don't cut yourself up over something that may not happen, i have been there to and know how you are feeling, concentrate on you and your family they are far more important than debt, be proud of the fact that you are doing something about it, but get on with your life your kids need their mum right now more than anything, relax - chill- spend some quality time with kids and forget about your debts, unplug phone and have a night off.

take care thinking of you

Hi Lisa, that's really good advice from Kerri. Also, as Saz says just because someone's IVA failed due to Black Horse it doesn't mean that yours will as an IVA is exactly what it says - individual. I have heard some bad things about one of my creditors, but they were fine with me - understanding and patient. They also voted to accept my IVA when I thought they would vote against.

As Kerri says, unplug your phone - you need to spend some time for yourself. You will get through this and please post any time you either want advice or just a rant x
