me and my partner are both serving in the army and are now pregnant we have about £25,000 worth of debt and want to make a fresh start we are struggling to have money to suvive once the debts are paid, are we eligabbe for an iva and can one of us have it all in one name to sae the other person getting a bad credit history? (for eg. i take on all the debt from both of us and only i get an iva and she starts a fresh debt free?)

Hi and welcome and congratulations on the impending new arrival.

It would depend on how much you owe and what disposable income you would have as to whether or not an IVA would be suitable for you, and you need to take professional advice. Visit www.iva.com for a list of companies, or you could contact Melanie Giles who posts on here, and whose details can be found under the experts link on the left hand side of the page.

She is ex-forces herself, and has a lot of forces personnel on her books. She would be able to advise you.

However, if some of the debt is in your partners name, or is joint, then she will need to take out an IVA in her own name. You wouldn't be able to take on all the debt.

The best thing to do would be to take advice from an insolvency practitioner. It is not a good idea to now transfer debts between each other, and I am not sure that creditors would actually agree to do this in any case.

Need to know exactly the mix of your individual and any jointly held debts. Then what your income and hoiusehold expenses are - then speak to an IP who will give you free impartial and appropriate advice.
