hi ,melainie i know you replied to a previous posting of mine regarding bailiffs ,but i just constantly worry about this more than anything else .
what it is ,is basicly i have my house on the market to offer a lump sum iva to creditors as you know ,and the council are going to re house me my husband and children due to over crowding ,what i am worried about is that my husband is trying so hard to sort out a fresh start for us and i am so frightened that bailiffs don't turn up at our new address as our house has been on the market since november ,things are very slow at the moment .
Can the court send out bailiffs rather than set up a repayment ccj from the off set or do you have a repayment plan and then bailiffs can only turn up if you don't stick to it ?
i just want to know if they would ever send bailiffs prior to any other action .

Mel is on holiday but rest assured BAILIFFS WILL NOT TURN UP unless you have ignored a CCJ order.
If a CCJ is obtained you will agree a monthly payment with the judge,just stick to that and you will not have any bailiffs attend.

thanks andy you don't know how good that has made me feel ,my husband is trying so hard and most of the debt is mine ,hes amazing to stick by us ,let alone start all over again ,thankyou for putting my mind at ease ,i'll try to make our new home nice for him now i know it'll be ok .thankyou again .

Hi depressed,

If you inform your creditors of you IVA proposal most of them will take no further but my advice is continue to pay what you can afford until your IP advises otherwise.

Do not forget! Never invite a baliff in! Always ask to see a warrant/court order. Check that they are court appointed and SIA accredited.

Also - if you do have a CCJ that for whatever reason has defaulted. You can put a N245 in to the court with a reduced offer. This is an application to vary an existing CCJ or suspend a warrant !

A bailiff has no rights of entry whatsoever so dont worry.
