If the IP has been proved to be negligent, would there not be a case for the fees to be taken away from them? Surely there is legislation somewhere which prevents IPs being paid if they have done wrong?

They are more likely to be fined by their regulator rather than having to hand back fees they were contractually entitled to draw - but these cases are quite rare.

this is it you put your trust in a company and ask them to deal with something and although they did, they haven't done it right
