Most of my creditors have left me alone since my IVA was passed last Friday. However one of my creditors the mobile phone company 3 are still contacting me demanding payment. I have told them that I have now entered in to a IVA but as they are based abroad they do not seem able to grasp what I mean. They have now passed the debt on to a collection agency who I have also informed that I am now in a IVA and they are not to contact me. Their respone was tough untill they are told by 3 to stop chasing me for the debt they will keep on contacting me. I spoke to my IP who said that I should try and contact 3s main office and tell them what is going on. When I speak to 3s C/S they refuse to give me the HQs office and just demand payment. Does anyone know where I go from here or do I just put the phone down on them as my IVA has been passed ?

Hi
Sometimes it takes time to filter through.There is no point in getting involved in a conversation with someone who clearly doesn,t understand the IVA.Give it another week then ask your IP to write to 3G.

I have read on another forum about 3 causing a problem - apparently they don't recongnise BR or IVAs!!!

If a IVA is legal document then how can they not recongnise it ? Surley once the IVA is in place then cannot enforce any action.

Exactly! I think the problem is that the people you speak to are in a call centre abroad and have no idea about UK laws.

So if they do not recongnise a IVA can they try and take me to court, or would it just be thrown out of court ?

No they cannot take you to court as you are protected by the IVA whatever they may try to tell you, so don't worry about that. I don't understand why your IP has said that you need to contact 3 - I think it should come from them.

They are legally bound by the terms of the IVA and is it illegal for them to harrass you??? I think so.

You may need to point this out to them.
