hi guys
just need a bit of advice, i have been in a contract with 02 for my phone for 12 months, they contacted me yesterday to offer me an upgrade on my phone at exactly the same tarriff, which is very good because i have been with them for years but the contract will be 18 months. i could do with a new phone as mine keeps randomly turning off which is frustrating as i am going through my iva and want to be contactable at aii times for my ip, BUT i am worried to ecxept the deal in case this is classed as taking out credit, not sure what to do. [?] x

I don't think it's classed as credit, you could always check with your ip incase. Be careful though, I recently upgraded with 3 and they credit scored me, because I'm br I can't have a monthly contract, so they cancelled the contract without warning. Now I can't have my old number-the one everyone knows-because it's not an active acc/number. It may be different with an IVA but you may be better off checking their T&C's to make sure,

I'm sure its classified as a utility Abby. When I went into an IVA my IP wanted me to have a mobile so I could be contacted. When I said I didn't want one he was surprised, and indicated if I changed my mind I'd have no problems getting one. So go for it is what I say.

I cant see the problem if you are already in a contract with them. All you would be doing is upgrading the phone thats all.

i did the same thing with o2 and it's fine.

Essentially you are just extending and existing agreement.

We have been in our IVA for 8 months now, and I upgraded my mobile with O2 last month with no problems at all they dont even do a credit check or score, as I have been with them for a couple of years and got a good payment record.
53 down 7 to go !!
Cant wait till December 2012

I have managed twice since I've been on my IVA to up grade my phone on a contract so I don't think it is a propblem

if your going to upgrade it wont be a problem. They only credit check you on new contracts. Recently upgraded mine and not a problem and I checked my credit report and no new search there.

Many are saying that they don't carry out credit searches but obviously 3 do. They said that the Insolvency Service had contacted them but the OR/IS didn't know that I had the contract with 3 so the only way they could have found out was by carrying out a credit search when I upgraded. My hubby who has had his contract from the same day as I did, went br on the same time/day BUT hasn't upgraded still has his contract with 3, is still connected and even had a call 2 days ago regarding upgrading!! 3 do apparently have a reputation regarding their opinion on br but how else could they have found out other than a credit check??

The thing is I upgraded no problem, then after 2 weeks they cut off my phone and when I contacted them they said it was because of the br....I've never missed a payment or been late, d/d set up from day one with them.....I've had to send the new handset back as the 'new' upgraded contract hadn't started, a right nightmare!!
It's nice to be back......
