What was the value of the debt owed to the creditor who voted, compared to the remainder of your creditors?

Hi Melanie.. thankyou for your reply. I owe 29k , the creditor who voted no and was the only creditor to vote was max recovery, the debt was for 3k and is actually 10 years old and was from 1997. I have never had any contact about this and actually thought it was written off. My other debts are with Nationwide, who have 23k of my debt in the form of loan, CC and overdraft. Other creditirs were, Capital One, Next, Lombard and Bank of Scotland, these four creditors are owed a total of 3k.

Then your IP should have put more effort into this and rung around for votes from the other creditors. I wonder why this did not happen - and suggest that you aske them the question.

What are the implications on you now as a result of the failed variation? Can you afford to continue making payments at the current level? I am sorry, but I feel that you have been badly let down by an IP who does not care too much about his client. You need to get some answers to explain his inactivity here.

I can't help feeling the accountancy profession is going to get another blasting for poor service!

There is no excuse for such poor service in my book Ray. We are all working hard, but have to remember our clients lives are in our hands to a certain degree.

Hi Melanie thankyou for your replies... No I can't afford to continue paying so I really don't know what to do. They are asking for another variation meeting at a proposed 245.00. All they seem to want is to take my money with little regard to my sanity and financial well being.

I'm despondant and really don't know what to do.... Just feel I have been unlikely and picked a poor Debt management company.

Thanks for everyones advice though and support.

Tell them that you have taken alternative advice, and that you expect them to now put forward the variation again at no extra charge, and that you expect them to represent you properly next time.

And try speaking directly to the IP rather than members of his/her staff.

Hi
Your telling them what they should be doing,you need to move forward as you are in the limbo stage and run the risk of your IVA failing and all the money that you have paid in going to the IP and nothing off your debts.

I contacted them..... Was told that they knew what they were doing and that my creditors were notoriously difficult, I wasn't aware of that . Also that if I put too much pressure on them they will breach me and that I wouldn't want that. I suppose they are right too as I haven't payed the full amount for about 7 months. They were very curt and rude and said that if I had been more responsable I wouldn't be in this situation. ( Like I didn't know!)[:(]

But if they say they know what they are doing - what exactly are they doing? You are being treated appallingly by a firm who appear to not care about their clients. And why did they let you go 7 months in arrears before they did something about it.
