hi, i am in the processs of setting up an iva with bains and ernst, the details have been passed to blair endersby, which i was not told about. When i last rang they said the proposal was comleted and we were waiting for a creditors meeting. I have just recieved a letter this morning from Blair Endersby informing me that that the file has been prepared and is ready for processing and that it has been passed to HJS- RECOVERY. Does anyone know about this firm i can not see any reviews and i have already paid b&e £356 so far, think they want another £356 at the end of this month. Which has made me get futher behind with my creditors. Can anyone help
Hopefully Blair Endersby will see this and put your mind at rest.

You wont get further behind paying your creditors as most people stop making payments to creditors as soon as they decide to try for an IVA. It may seem strange but IMO its the right thing to do.
Discharged today the 8th feb 2012. View is much brighter now.

hi, and thanks for your info, i take it hjs recovery is part of blair endersby. I just hope it all gets sorted soon i didn't even know what an iva was until i spoke to bains and ernst. I don't know what i will do if our iva is rejected. I can't wait for the phone calls and letters to stop. I have been reading up on everything on your forum and found it really comforting and helpful. Just hoping our creditors don't object, we live in a rented house so i'm hoping that the iva will seem the best option to the creditiors as we have no savings or valuable assets. thanks again
I don't want to go down the bankruptcy route as my family and friends no nothing about my debt problem and i think your name goes in the papers etc, plus i really want to repay as much as our debts as possible. When i contacted b&e they never mentioned bankruptcy as a solution, i had contacted them in relation to starting a debt management plan but they have said the IVA would be the best option for me. This is all so confusing i have been trying to get an idea of creditor voting patterns but some of my creditior's don't appear to be listed on any sites.
I'm really worried that my IVA will be rejected and i'm futher behind on our payments and i'm still going to have to pay B&E a futher payment of £356 which is all of my disposable income so i have been struggling even to pay the token payments that have been mentioned.
lw10, can you post us detail of who your creditors are? We might be able to tell you how they have been voting for us.

hi, creditors are welcome finance, provident personal credit, halifax which i have two overdrafts and a credit card, and bank of ireland, next and two aqua credit cards, i think aqua are part of halifax as well.

Halifax were one of my creditors, and they didn't bother to vote. I have had no dealings with welcome, provident or aqua.
There are some technical experts who post on here, and as soon as they see this, they should post with some further advice.
Most of us stopped our payments before our IVA's so you are not on your own there. I didn't even make token payments once my proposal had gone in.
As far as bankruptcy is concerned, it is only the local paper you need to be concerned about, and it is a small piece, so unless your relatives scour every part of the paper, you may get away with it.

thankyou, so if i have most of my debt with halifax and they don't bother to vote does that mean the iva will be rejected even if the others agree to it.
If they don't vote, then usually it is taken that they have accepted.
I only had one creditor vote yes, and that was RBS (Direct Line and Lombard Direct) with whom I had a credit card and a loan. Lloyds TSB voted no, and all the others didn't bother, Halifax inluded.
One of the technical experts will be along at some point (bear in mind they give up their free time to post on here), and they will advise you further

You should have had all the options pointed out to you when your IVA was first discussed, I was sent a booklet to read. There is a lot that goes on in your head at a time like this so it may be quite possible that you missed the mention of BR. By no means do I mean to be cynical but it may be that B&E suggested an IVA because that's the way they earn their fees (i.e a successful IVA rather than BR) ... but then I am sure that they wouldn't have suggested it unless they thought that it had a good chance of being accepted as it's a lot of work on the part of the IP to prepare and put through the IVA.
I really would think about however the longer term. You will be tied into an IVA for five (possibly six) years. With BR you will most likely be discharged in a year, giving you a fresh start. I would seriously not let the slight possibility that your family might see a listing in the paper to determine such a crucial life decision for you ... and what if they did? BR really does not hold the stigma that it used to do.
Nevertheless, you really demonstrate that honourable and admirable attitude that so many of us have that you want to do the right thing by your creditors. I wish this was recognised more by the creditors and the financial world in general that the vast majority of us are not out to escape our debts but instead to find a workable solution to a problem.
No br was never mentioned, they completely dismissed the debt management plan and only discussed the iva option. Just seems strange that it was b&e i spoke to first, then it was blair endersby and now it's HJS recovery. Don't know were i am at the moment. They seem to be to ok so far. I just want this to be sorted it is always at the back of mind, i'm probably just stressing but cos i don't know much iva's or anything and i havde to trust what these companies are telling me.

I am with Blair Endersby and they actually sais to us we would be better of going BR as we lost out house..but we just really wanted to pay back what we could.
I am pretty sure there is another branch of Baines & Earnst that deals with BR...but I could be wrong!
It can be a seemingly long road lw10 but it sounds as if you are quite a way long it now.
Some IVA applications are passed through a chain of companies which are all connected in some way ... my very good IVA started off with me ringing and 'introducer' from the Sunday paper. It's a bit like an introduction agency!! [:)]
