Hi

I am almost into my 4th year of my IVA and it is the time of the year again to fill out my expenditure sheet.

I currently live with my girlfriend in her house who has no debts whatsoever and is not linked financially to any of my debts. On my expenditure form that i have to complete, my girlfriend has made it clear to me that i do not put anything on there concerning her and refuses to pay anything towards my debt; i have only entered in my half of the form with what i give her in rent/lodgings, the food that i pay for etc.

My girlfriend is worried that money might be taken from her because i am living under her roof with my IVA. My IVA will not affect my partner will it as my IVA began long before i met her?

no money will be taken from your girlfriend.

all they want to konow is both your income and expendatures so they can work out your both paying a fair shire to the house and work out what you can afford to pay back from that.

Hello

I am wondering about something along the same lines.
If you are in an iva and then move in with someone or get married does your partner have to submit information of what they contribute to the IP?
What if they are unwilling,do not know of your iva or are on benefits/unemployed? Do you keep quiet about it and continue with your set payments?
If your IVA is calculated based on your cost while you are in a relationship what happens if the relationship ends?

Yes - as you need to make an accurate disclosure of your circumstances. But you have no legal obligation to disclose the IVA to them, so long as you are aware of their income level.

On the other hand if the relationship ends, then you will need to complete a new income and expenditure form to show your revised position. If this results in you not being able to afford to service your IVA, you will then need to consider whether a formal variation of its terms is necessary.

Hello again

Thanks for the info, it has been helpful. A thought just occurred to me. How will the IP or creditors know if someone does not declare that they are living with someone? I know it is wrong but I suspect this happens.For example, where the partner in the IVA pays all the bills in the household having declared that they live alone. Are there safeguards for this sort of thing?
