My IVA has completed in June, since it's six years (additional year added as equity in house)since inception it's now no longer on my credit record. Do I have to declare that I have had an IVA in mortgage quotes etc?

If the application form asks you specifically you will have to. However, if the question was "Have you entered into a voluntary agreement within the last 5 years" you would be able to say no.

Hi sjp,

No, you dont have to declare that you have been in an IVA unless they specifically ask you.

Thanks for the replies. Sorry, maybe I should have been more specific. What is the legal requirement of disclosing a completed IVA. If it's no longer on your credit record do you have a legal obligation to declare. If so, how long for? Would credit companies for example, trawl though court records exceeding six years?

As you can guess, the "rub" is really how long before you can be really free from an IVA.

Credit providers use your credit file from usually one sometimes two agencies out of Experian / Equifax / Callcredit. They don't trawl old court records.

You are required to complete all applications for credit in an honest way - if you don't you are likely to flags against you at Hunter / CIFAS.

So if the application form says - have you been in an IVA or Bankrupt in the last 5 years the answer is 'Yes'
