Hi, i have an IVA in place and the 4th year starts in January. I have never missed a payment or took a payment break. But in the post this morning i receive 3 letters from solicters acting on behalf of a company that bought some of my debt. They are insisting on full payment before the end of this month or they will start legal procedings. Am i right in thinking they are just trying it on and there is nothing legally they can do. My wife is now worried sick about this. I cant ring my IP as there is no one in the office till Monday.

Hi Deanno,

I presume these debts were included in your IVA? If so, there is nothing any solicitors can do about it. All the companies are legaly bound by the IVA, so I think the solicitors are just trying it on.

Your IP should be able to sort it on Monday.

Hi Deanno,

I second what Kali has to say ... tell em to bog off
When I was young I was called a rugged individualist
When I was in my fifties I was considered eccentric
Here I am doing and saying the same things I did back then and now I'm labelled senile

Tell the wife to relax and not to worry about these. Its just some companies tactic to try to get more out of you. If the debts were included in the iva then either rip up the letters or send them on to your Ip and let them earn there fee by dealing with it for you(they will rip them up anyway)
Discharged today the 8th feb 2012. View is much brighter now.

Hi, thanks every one for your replies. Yes the debt were included in the IVA. But i will contact my IP Monday just to be safe. It's a shame they can't be penalised for harassment.

What a waste of solicitors fees chasing a debt thats included in your IVA. You mustnt worry as you are legally protected as other have said and theres nothing they can do now to make you pay.
Have your IP give them a call and put them straight.

Pity they don't do a little more research before sending these letters out and charging lord knows how much for them!

Deanno, I hope you have spoken to your IP and that you can now put your poor wife's mind at rest.

update on this, i spoke to my IP and its what been said on here. My IP asked me to forward the letters on to him and he dealt with them. I then phoned up the company involved "Eversheds" acting on behalf of Max Recovery and they actually appoligised and told me i would receive no more letters. Forgot to mention my IP said they have had numerous phonecalls about said company and their letters. But i'm happy and more important my wife is as well.
