Just got our letters from the OR following our BR on the 11th.

Apart from the kitchen sink, they want everything. Every bit of paper work i can find, and also my bank cards!!!!

I mean my debit card, of which there is no debt attached. The OR clerk told me to tell the bank, which i did, and they said to carry on using my bank til they got notice from the OR, and although she couldnt say for definite they could see no reason why my acc wouldnt be left open.

So what am i to do if they want my bank cards, how can i get my benefits, wages, and pay for things? they want my hubbies to, i just dont know what to do, and it says any money in the bank on the day will be taken, but all money is ear marked for bills or DD.

Help!

And to top it off, our lanlady has rang and left a message today, the day we got our letters, so i assume she now knows :o(((

Hi flashingblade

Have they asked for 12 months statements from all creditors and 12 months bank statements? If so, you can only send them what you have. I was luck i keep 12 months before i start to shred them.

If you are going to be allowed to keep your account open then dont send that card, as you say you are going to need it. I only sent back cards that had any debt to them (maybe that was wrong) but i only have my coop cashminder debit card now. If the bank is happy with you keeping it then i would keep hold of it. Could i ask did you have a coop account?

Ok, before you call your landlady just try and relax as she may not know and it could just be a coincidence. If she does know then she may just want to clarify a few things with you - dont worry before you know what she wants. Maybe have a read through your tenance agreement and see if it says anything about br.

Please let us know how you get on

Jenny

I would put a covering letter in explaining that the bank has allowed you to carry on using the account and therefore you haven't included the debit card.

Don't worry if you haven't got all your statements - as Jenny says the OR can easily get them from your creditors.

Good luck with the interview x

Hi Flashing Blade

The Official receiver just wants to have as much information as they can with regard to your debts - let them have whatever paperwork you have - they will be writing to the creditors anyway at some point. As Moneyworries has stated only send in your cards (defaced first ie cut through the little gold square where the chip is or cut the card in half (most people just cut and destroy themselves and inform the OR that they have done this)Hopefully you will have openend a new basic bank account, if so,DON'T send the card for this account - the normal course of events is that the OR will notify the bank that you are able to continue with this account - the OR does not freeze accounts the bank does, but on receipt of notification by the bank will usually unfreeze and account to enable you to have access to money provided this is a basic account with no overdraft facility and not linked to any of your other debts (ie bank loan / bank issued credit cards)

Your lanlord will have been written to as a matter of course, but this is usually nothing to worry about and your landlord, may just be checking that you are able to continue to pay your rent, that is usually all they are concerned about - as long as they are going to continue to get their rent the bankruptcy will normally not concern them.

Hope this helps
Melanie

Don't make the mistake I did - Lloyds had told me I could keep my full current account and the OR had no interest in it, but I accidentally cut the debit card up and sent it to the OR! When I rang Lloyds they would only send me a basic cashcard that could only be used in their own cashpoints, so I had to open a new account.

Just to add to what Melanie has said.

The OR basically just wants to check that you don't have lots of money stashed in your current account. If there is any surplus over what you will need to cover your living expenses for this month, the OR will ask the bank to send this to him or her. The OR cannot take any money you need to cover your essential bills and living expenses.

It is usual for the bank to freeze a current account whilst the OR is investigating the contents in it. Just to make sure that no money disappears. The OR will then instruct the bank to unfreeze the account once he or she has received an up to date balance of the monies held in it.

If you do not send the OR your bank card then just let him or her know that you have not sent it and why.
Kind regards, Elizabeth Pywowarczuk, Insolvency Practitioner.

If you are worried it wont get there in time, why dont you send it 1st class recorded, i did it this way and also you can check online when the OR's office will have received it.

Actually im saying that and a week or so after they received mine i got a 'receipt' type letter confiming it also.

Just send what you have and dont panic about what you cant send.

Take care
