New Car MOT Gone Very Wrong

Hi Forum, well I never thought Id be in this situation again. this time last year our old car needed alot of work doing to it which went into thousands, so we took a payment break of 2 months & traded in the car for scrap & bought a new second hand one from a car dealer.
We struggled to find one for the money we had so my parents put some money into to it, as you know Im there main carer & run them about etc.

Last Tuesday our new car went in for its MOT & service & failed so so badly, it had 17 faults 9 of them being serious ones, the most costly one it needing a new engine. We had only had it 11 months. The garage we use were brilliant spent alot of time which they did not charge us for testing etc but the costs outweighed what the cars worth & went into thousands.
We are devastated & between our selves & the garage we have come to the conclusion the dealer must of been aware of these faults as they can not of occurred after us having it only 11 months. As its tax was running out too we have had to scrap the car & it was also to dangerous to drive. Words can not describe how we are feeling at the moment & I cant see the woods for the trees!
My husband is currently having to take taxis to work as there are no buses running at the times he leaves & finishes, and even if there were it would take 2 buses to get to his place of work, it also would not be practical as he's the head of his department & needs to get there when needed etc.
Myself & parents are left stuck for getting about to hospital, taking the children out, shopping etc. In the cut backs the council had reduced our buses to one every half hour between 9am-3pm thats it! And where we live is far away from everything. After less than a week without a car, Im finding Im spending more than I did when we were paying out for a car, including all aspects of running & owning one.
Im yet to find the strength on what action to take on the dealer that sold us the car, unfortunately its not a local one.
My IVA is with GT, We only have 11 payments left now too, Im yet to get in touch with them as its knocked me for six. Leah is 20 weeks old & Im trying to be strong for her & the boys.

Any Ideas on a way forward would be appreciated!

Really sorry to hear about the problems but speak to GT straightaway and get another break if at all possible. The car is essential and I am sure GT will be able to help.

A small claim may be the best way to recover the money from the dealer especially given the report from the garage and the number of faults. Speak to your CAB who can have a representative at court with you and hopefully you can get the money back.

Lyns we both really feel for you, we know how much you have struggled.

I agree with Michael that GT will be helpfull, this isn't your fault and I hope you can get it sorted out soon. Wished we lived closer so that we could help.

You must be reeling! I'm so sorry. Totally agree with Michael about putting in a claim as with the garage report the dealer doesn't have a leg to stand on. Speak to GT too and advise them of your new I&E showing public transport and taxi costs. When my car conked out I too had to take multiple forms of transport and taxis to commute (2 buses and a tube each way normally and taxis for late shifts) and it cost more than me leasing and runing a car based on a small car with a circa £150pm lease. You may be allowed to lease too as I imagine your revised I&E will similarly show being carless is more expensive than leasing.

Thank you all,

I have never felt so ripped off in all my life, its not just affected my husband & I, but my parents too. We had put 4 new tyres on it since buying it as well, as those were the only notices on the previous MOT Certificate. The garage we use were just as horrified as us at the faults on it. I had to pay for the MOT & engine diagnostic test, but they spent 2 days on it & did not charge me for the labour.

Im definitely going to take if further - I just didnt know how, thank you Micheal.
We have paid up the 2 month payment break we took last year. And I had been very good at saving up for its MOT, so I have a small pot of money to start with, Im thinking of taking a one month break & asking if we can keep all of my husbands overtime from this month & whats he's owed next month to add to it?
I know leasing a car wont be possible within our expenditure & running a car after leasing one, but thank you BOL.
Im just devastated & so angry & part of me feels ashamed n stupid, but I was pregnant at the time I bought it & didnt know, so Im blaming hormones too!

Given that its a second hand car I cant see how any court will award in your favour lyns(and the costs to drag a garage to court may be rather prohibitive). I assume the car has no warranty etc etc. Cars are terrible things when they go wrong,especially like in this case its spectacular(as was my laguna when the turbo blew up and knacked the engine).
What are the selling garage saying about things,they may be willing to do some sort of deal but it would be on a goodwill basis,and not because they have to.

You really have to sort something out,could parents lease a small car short term until the IVA is concluded at least?

Hi Paul, I was thinking I didnt have a leg to stand on too, 3 month standard warranty came with it & it only covered mechanical things.
If I cant get any "free" help with taking any further action then I cant afford to do it, nor do I have the strength or time.

Parents know nothing of the IVA, my Dads 80 & going blind & can no longer drive, my Mum is away with the fairy's & very poorly with various problems. Hence why Ive not been of the forum much as things have just gone from bad to worse with them both, on top of 2 boys & a new baby, my life's a bit hectic! Then there's the husbands health & work issues on top, I really did not need this right now!

When my car blew up it had less than 70,000 on the clock was 7 years old and had a full service history(because I couldnt guarentee what grades of oil had been used it didnt matter). Renault still didnt give a hoot and offered as a gesture of goodwill 10% off a new engine.

At £4,000 fitted and the car valued at about £1800 it was clear that I was up the creek without a paddle.

A payment break and a family loan helped fund the VW(which is nearing 12 years old with 100k on the clock),although it did just pass its MOT earlier this month with just 3 advisory notices for minor things.

It really would be good to be able to take the garage to court etc but I dont think you will have any joy without spending money to get a result which isnt possible when your spare cash is limited.

What age of car and mileage was it Lyns?

Year of car 2002 Ford Focus & 79,000 on the clock when we bought it, 83,000 when we put it in for its MOT.

I feel rubbish now :(

Are you eligible for a movability car as one of the primary uses is caring for your parents? I know just how you feel Lyns and it's a lot to cope with on top of the new baby, elderly parents and general hullaballoo of family life. Could yu call GT today? It might help put your mind more at ease just knowing they are on your team x

I wouldn't think so BOL - the motability part of the care component would have to be applied for by her parents and, if they are over 65 then they won't be able to get a car. They might get the allowance but of course these things are being clamped down on at the moment.

I think you have to be under 65 to apply for DLA mobility, however Lyns parents probably would be entitled to attendance allowance...
